Workers' Compensation: an overview

Workers' compensation laws are designed to ensure that employees who are injured or disabled on the job are provided with fixed monetary awards, eliminating the need for litigation. These laws also provide benefits for dependents of those workers who are killed because of work-related accidents or illnesses. Some laws also protect employers and fellow workers by limiting the amount an injured employee can recover from an employer and by eliminating the liability of co-workers in most accidents. State statutes establish this framework for most employment. Federal statutes are limited to federal employees or those workers employed in some significant aspect of interstate commerce.

The Federal Employment Compensation Act provides workers' compensation for non-military, federal employees. Many of its provisions are typical of most workers' compensation laws. Awards are limited to "disability or death" sustained while in the performance of the employee's duties but not caused willfully by the employee or by intoxication. The act covers medical expenses due to the disability and may require the employee to undergo job retraining. A disabled employee receives two-thirds of his or her normal monthly salary during the disability and may receive more for permanent physical injuries or if he or she has dependents. The act provides compensation for survivors of employees who are killed. The act is administered by the Office of Workers' Compensation Programs.

As Australia experienced a relatively influential labour movement in the late 19th and early 20th century, statutory compensation was implemented very early in Australia.

South Australia

In South Australia legislation was enacted in 1986 called the Workers Rehabilitation and Compensation Act. The WorkCover Corporation of South Australia WorkCoverSA has the responsibility for administering the Act.

New South Wales

In NSW, workers compensation is governed by the Worker's Compensation Act 1987. WorkCover NSW is a statutory authority within the portfolio of the Minister for Finance. Its primary objective is to work in partnership with the NSW community to achieve safe workplaces, effective return to work and security for injured workers.

Victoria

Workers Compensation is managed in Victoria by WorkSafe Victoria" which has the role of managing Victoria's workplace safety system. The responsibilities broadly are help employees avoid workplace injuries occurring, enforcement of Victoria's occupational health and safety laws, provision of reasonably priced workplace injury insurance for employers, assisting injured workers back into the workforce and managing the workers' compensation scheme by ensuring the prompt delivery of appropriate services and adopting prudent financial practices.

Tasmania

Tasmania's Workers Compensation system is managed by WorkCover Tasmania which takes its role seriously in Workers Compensation. It monitors and ensures safety and prevention including producing publications, education seminars, assists businesses with an advisory service, oversees the accreditation of medical practitioners, ensures that employees are insured and licensed and also promotes special events.

There is also the Association of WCBs of Canada (AWCBC). I just realized belatedly that I typed in the wrong answer when looking at different acts. My answer should have read (Swedish) Industrial Injury Insurance Act (1954:243). The rest of my answer was correct. I realize that the question has been closed and just wanted to amend my answer for the record.
