Discussion

Gert Sass (M.A.) Feb 6, 2007:
Quite obviously, "diligence obligations" works as a generic term (which also comprises documentation, compliance with standards, etc.) in German/Austrian law, while "clarification duties/obligations" (or maybe "assessment") is more equivalent here.

Thank you guys for all the ideas! Before selecting the most helpful answer though (I tend to select "special due diligence obligations"), I need to clarify this: Further in the document it says: "Die Ueberwachung der Geschaeftsbeziehungen ist primaer Sache der zustaendigen Kundenbetreuer.
Now are these "Abklaerungen" simple "clarifications", or are they the first component of "Abklaerungspflichten", i.e. "due diligence"? Do I need to decide on the "Abklaerungspflichten" according to the meaning of "Abklaerungen", or are these two independent?
I appreciate any idea that would get me out of this confusion! Thanks again!

Please see the solution in the note added only, I have taken "Abklärung" for "Erklärung"

special due diligence obligations

In the US, this refers to the restrictions imposed by the US Patriot Act (which probably spawned the EU legislation)

Christiana, re: your question above: "clarifications" are Erklärungen, Erläuterungen, etc. - a lot more informal than what is meant here. These here are serious legal requirements that need to be fulfilled; and yes, individual employees will carry out due diligence investigations.
