Summons UNITED STATES DISTRICT COURT:

3. Plaintiff brings this action to recover damages for the overpayments they made to XXX as a result of Defendants´ unlawful conduct which included:

a. providing home dialysis equipment and supplies to Plaintiff members through XXX, a shell corporation which existed solely as a billing conduit, in a scheme to enable Defendants to bill Plaintiff at a higher rate than they would otherwise have had they billed the Plaintiff directly;

b. submitting claims to Plaintiff for payment for standard home dialysis supplies and equipment, including emergency supplies and antibiotics, which it did not provide to Plaintiff members;

c. engaging in "split-vial dosing" and "off-label" administration of ancillary medications in violation of Medicare regulations and standard medical and pharmaceutical practices in order to pad the bill to Plaintiff;
