An example of a substitution clause being ineffective was seen in the recent case of Redrow Homes (Yorkshire) Limited v Buckborough. Buckborough was a bricklayer who wished to make a claim under the Working Time Regulations. In order for his claim to be successful, he had to show he was a worker under the Regulations. However, there was a substitution clause in his contract which provided that he could find another worker to perform the work if he wished.
