Plângerea prealabilă este încunoştinţarea făcută instituţiei/ organelor competente de către partea vătămată, despre comiterea unei infracţiuni de către o persoană fizică sau juridică, pentru ca aceasta să fie judecată şi sancţionată potrivit legii, constituind în acelaşi timp o condiţie indispensabilă fără de care nu se poate pune în mişcare acţiunea penală.
Plângerea prealabilă este obligatorie pentru anumite fapte prevăzute de lege, faţă de care organul de urmărire penală nu poate începe urmărirea penală, ca în cazul infracţiunilor de: vătămare corporală, vătămare corporală din culpă, violare de domiciliu, divulgarea secretului profesional, viol, gestiune frauduloasă, distrugere, denunţare calomnioasă, bigamie, abandon de familie, nerespectarea măsurilor privind încredinţarea minorilor, tulburarea folosinţei locuinţei.
Termenul de introducere.
Potrivit art. 284 C. proc. pen., în cazul infracţiunilor pentru care legea prevede că este necesară plângerea prealabilă, aceasta trebuie introdusă în termen de două luni din ziua în care persoana vătămată a cunoscut cine este făptuitorul.
Persoana împotriva căreia se poate face plângerea.
Plângerea se face împotriva persoanei considerate vinovată de săvârşirea unei infracţiuni, indicându-se, obligatoriu, numele, prenumele, domiciliul ori reşedinţa unde poate fi citată, datele de stare civilă şi, eventual, părţile responsabile civilmente, în cazul infractorilor minori.

Preliminary complaint means the act of informing by written report the institution / competent authorities by the victim about the commission of an offense by either a natural person or legal entity, with the purpose that this offender be tried in a case and punished in accordance with the law, constituting at the same time, a condition sine qua non to initiate criminal action.
The Preliminary complaint is mandatory for certain offenses under the law in respect of which, the criminal investigation body is not entitled to initiate public prosecution in offenses such as: physical injury, physical injury through negligence, trespassing, disclosure of professional secrecy, rape, fraudulent management, destruction, the offense of making false accusations, bigamy, family abandonment,non-compliance with the measures regarding child custody, nuisance.
Time frame for filing preliminary complaint.
In accordance with the provisions of Article 284 Code of Criminal Procedure in the cases of the offenses where the law requires a preliminary complaint, this may be submitted within two (2) months from the date the aggrieved party acknowledged the offender.
The person against whom a lawsuit is filed.
The complaint is made against the person considered guilty of committing the offense, mandatorily pointing out the last name, first name, the domicile or the residence where the offender lives, marital status, and, if case may be, the parties with civil liability, in the case the offenders are juveniles.
