12.Packaging and aging validation reports – the shelf life validation evaluations were performed, originally, for members of the Fixion Nailing Systems (another family of nailing systems by XXXX Ltd.). The same reports are relevant also for the XXXX Composite Systems, which are packed in the same packages, and are sterilized using the same sterilization methods. The documents include a 5-years shelf life validation after steam sterilization (performed originally for the FFFF implants), and a document indicating compliance of the results of that validation to the XXXX Composite implants.
13.Sterilization validation reports – including: documents for XXXX Composite Nails sterilization validation (which is relevant also for the plates), and documents for instrumentation set validation. It is noted that, in addition, the autoclave used for steam sterilization is re-qualified yearly.

7.1. Für den Fall, dass der UNTERNEHMER die nachfolgenden Termine nicht einhalten kann, ist eine Konventionalstrafe von xx % vom Gesamtauftragswert pro nicht eingehaltenen Termin geschuldet.

Die Konventionalstrafe wird fällig am ersten Tag nach Ablauf der jeweiligen Frist.
Die Bezahlung der Konventionalstrafe entlässt den UNTERNEHMER nicht aus der Pflicht, die Leistungen vollständig zu erbringen.
Die Verrechnung der vom UNTERNEHMER an ROCHE geschuldeten Konventionalstrafen erfolgt soweit möglich mit Gutschriften.
7.2. Bei Verspätungen, die durch ROCHE entstanden sind, verschieben sich die Termine um die Zeit der Verspätungen. Der UNTERNEHMER muss diese Verspätungen und die daraus entstehenden Konsequenzen unmittelbar nach den Ereignissen schriftlich mitteilen.
7.3. Sollte der UNTERNEHMER den vertraglich festgelegten Einbringtermin (Termin e) trotz des verspäteten FAT-Starttermins einhalten können, so wird ROCHE auf die vorgenannte Konventionalstrafe (Termin d) verzichten
7.4. Bei Nichteinhaltung pro vertraglich festgelegten Termin gemäss Ziff. 1 werden pro zusätzlich verspäteten Arbeitstag, zusätzlich zu der unter Ziff. 1 genannten xx-prozentigen Konventionalstrafe, weitere yy % Konventionalstrafe des Gesamtauftragswertes geschuldet, jedoch maximal zz % pro Termin gemäss Ziff. 1.
