§ 5 Technische Hilfe
1. Die LIZENZGEBER sind bereit, einzeln und/oder gemeinsam, dem LIZENZNEHMER technische Hilfestellung zu leisten und dabei ihr KNOW-HOW zu vermitteln, soweit dies für die Herstellung des LIZENZIERTEN GEGENSTANDES durch den LIZENZNEHMER erforderlich ist und die personellen Möglichkeiten der LIZENZGEBER dies gestatten.
2. Über die Einzelheiten, insbesondere welcher LIZENZGEBER die technische Hilfe leistet, den Umfang der Personalgestellung, die Bezahlung der Hilfestellung sowie die Modalitäten der Abstellung von Personal durch die LIZENZGEBER werden sich die Parteien im einzelnen verständigen.
Sämtliche Kosten der technischen Hilfestellung trägt der LIZENZNEHMER.
§ 6 Übergabe von technischen Daten
1. Der gemäß § 5 Absatz 2 festgelegte LIZENZGEBER übergibt innerhalb von 2 Wochen nach Inkrafttreten dieses Vertrages die TECHNISCHEN DATEN gemäß Anlage 3 und zwar in der Form und in dem Umfang, wie diese bei ihm vorhanden sind.
2. Alle TECHNISCHEN DATEN werden in deutscher Sprache und metrischem Maßsystem in jeweils einfacher Ausfertigung übergeben.
1. Der LIZENZNEHMER hat das Recht, im benötigten Umfang und in der benötigten Anzahl Kopien der TECHNISCHEN DATEN herzustellen. Diese Kopien dürfen ausschließlich für die Herstellung des LIZENZIERTEN GEGENSTANDES verwendet werden und sind vom LIZENZNEHMER mit einem Vertraulichkeitsvermerk zu versehen.
2. Die aufgrund dieses Vertrages erhaltenen INFORMATIONEN sind vom LIZENZNEHMER vertraulich zu behandeln, vor dem unberechtigten Zugriff Dritter zu schützen und dürfen nur im Rahmen des § 4 an Dritte weitergegeben werden.
§ 8 Lizenzgebühr
1. Für die durch diesen Vertrag erteilte Lizenz zahlt der LIZENZNEHMER an die LIZENZGEBER eine Stückpreislizenz in Höhe von € 25,-- (zzgl. Umsatzsteuer) je LIZENZIERTEM GEGENSTAND zur Verwendung in einem lokalen Netzwerk, das unter Benutzung eines der lizenzierten VERTRAGSSCHUTZRECHTE und/oder der übermittelten INFORMATIONEN hergestellt und/oder benutzt wird. Dies gilt unabhängig davon, ob der LIZENZIERTE GEGENSTAND selbst unter Benutzung der genannten VERTRAGSSCHUTZRECHTE/INFORMATIONEN hergestellt und/oder benutzt wird.
2. Sämtliche Umsatzsteuern und indirekte Steuern, die auf die Lizenzzahlungen entfallen, gehen zu Lasten des LIZENZNEHMERS. Gegebenenfalls sind diese gegenüber den LIZENZGEBERN eingeforderten Steuern vom LIZENZNEHMER im Namen der LIZENZGEBER zu bezahlen.

§ 5 Technical assistance
1. The LICENSERS are prepared, separately or in co-operation, to give technical assistance to the LICENSEE and to communicate their TECHNICAL ABILITY so far as is necessary for the production of the LICENSED OBJECT by the LICENSEES and as far as the LICENSERS’ personnel capabilities permit.
2. The parties will together decide on a case-by-case basis about specific details, and in particular which LICENSER gives technical assistance, the area of staffing, payment for this assistance and provisions for withdrawal of staff from service by the LICENSERS.
The LICENSEE is responsible for the total costs for technical assistance.
§ 6 Transmission of technical data
1. The LICENSER, as determined according to § 5, paragraph 2, will impart the TECHNICAL DATA within 2 weeks after this contract has come into effect, as per Attachment 3, and namely in the same format and in the fullness that they are available to the LICENSER.
2. All TECHNICAL DATA will be given in German and using the metric system, and there will be one copy in each case.
§ 7 Duplication of technical data and data protection
1. The LICENSEE has the right to produce the necessary number of copies of the TECHNICAL DATA when necessary. These copies are to be used exclusively for the production of the LICENSED OBJECT and are to be provided by the LICENSEES along with a note of confidentiality.
2. The DATA obtained on the basis of this contract is to be treated confidentially by the LICENSEE, to be protected from unauthorised third party access, and may only be passed on to third parties as per § 4.
§ 8 Licence fee
1. For the license given by means of this contract, the LICENSEE is to pay the LICENSER a licensing unit price of €25, (inc. sales tax) for each LICENSED OBJECT to be used in a local network, which is utilised and/or produced under one of the licensed RIGHTS TO COMPLETION OF CONTRACT and/or the communicated DATA. This is valid independently of whether the LICENSED OBJECT itself is produced and/or utilised under the named RIGHT TO COMPLETION OF CONTRACT / DATA.
2. Total sales tax and indirect taxes that are not included in the royalty payments fall to the LICENSEE. If necessary, these taxes required from the LICENSER are to be paid by the LICENSEE on behalf of the LICENSER.

Dem Anwendungssystem „Beratungstechnologie“ liegt eine Schichtenarchitektur zugrunde, um die komplexe Gesamtstruktur in Teilbereiche zu untergliedern, welche jeweils eine definierte Verantwortlichkeit besitzen.
Die Schichtenbildung reduziert die Gesamtkomplexität, da jede einzelne Schicht ihre eigenen Aufgaben hat, und mit anderen Schichten nur über klar definierte Schnittstellen interagiert. Grundsätzlich gilt hierbei, dass Schichten jeweils Services der darunter liegenden Schichten nutzen können, während die untergeordneten Schichten nichts über die ihnen übergeordneten Schichten wissen dürfen.

Folgende Schichten werden gemäß Abbildung 2 in der BT unterschieden:
• Interaktion
Die Interaktionsschicht umfasst alle Architekturelemente, welche für eine direkte Interaktion mit Clients benötigt werden. Neben der Darstellung von Online- und Offline-GUIs werden hier auch die Bereitstellung von Services in Form von Webservices und Internet-Rechenkernen behandelt.
Die Offline GUI wird auf Grundlage der Rich Client Plattform (RCP) mit SWT realisiert, während die Webpräsentation der Online GUI mit Java Server Pages (JSP) / HTML entwickelt und in dem Servlet-Container Tomcat aufbereitet wird.
• Interaktionssteuerung
Die Interaktionssteuerung sorgt mandantenspezifisch für das Laden und Speichern der Anwendungsdaten, steuert die Navigation in der Online- wie auch der Offline-GUI und stößt die Verarbeitung an. Darüberhinaus werden der Druck und der ADT-Postkorb von hier bedient.
Es handelt sich um eine reine Java-Implementation in Form von POJOs (Plain Old Java Objects) auf Grundlage des iPOS-Frameworks. Einschränkungen hinsichtlich der Verteilung für den Online- und Offline-Einsatz bestehen nicht.
Die Verarbeitung erfolgt statefull.
• Produktlogik
In dieser Schicht sind alle Produktregeln, -evaluierungen, Aufbereitung von Druck- und EES- Daten, etc. angesiedelt, welche einem Hauptprodukt oder einzelnen Produkt zugeordnet werden können. Jedem Produkt ist ein Hauptprodukt logisch übergeordnet, wobei diese im Besonderen auch spartenübergreifende Bündelprodukte abbilden können.
Schnittstellen bestehen zu den Basisdiensten UniPost, NormRisk, TRIAS, ZÜRS, BLZ sowie der Mandantensteuerung.
Die Realisierung erfolgt in Form von POJOs (Plain Old Java Objects), so dass keine Einschränkungen hinsichtlich Verteilung für die Online- und Offline-Einsatz bestehen.
Die Abbildung der Produkte erfolgt in einer Baumstruktur, in der die Produkteigenschaften über Attribute ausgedrückt werden. Plausibilisierungen und Regeln werden pro Attribut in einer Metasprache deklariert oder können alternativ - ab einem gewissen Komplexitätsgrad - in Java programmiert werden.
Die Verarbeitung erfolgt stateless.
• Beitragsrechner
In dieser Schicht erfolgt die Beitragsberechnung spezifisch für ein bestimmtes Produkt. Die Realisierung kann in unterschiedlichen Programmiersprachen (Java, C ) bzw. deklarativen Ansätzen (VP/MS) vorgenommen werden.

The “Advisory Technology” applications system is structured in layers in order to break down its overall, complex structure into sub-sections that each have a defined function.
This layering means less overall complexity, as each layer has distinct functions and only interacts with other layers through clearly defined interfaces. As a rule, whenever this interaction takes place, each layer can make use of services provided by the lower layers, whereas lower layers must not have any knowledge of the layers above them.

The following layers are distinguished in AT, as shown in Figure 2:
• Interaction
The interaction layer comprises all the architectural elements necessary for direct interaction with the client. Here, functions such as web services and internet-based calculation engines are run, and the online and offline GUIs are displayed.
The offline GUI is implemented on a Rich Client Platform (RCP) with SWT, while the online GUI’s web presentation is developed with Java Server Pages (JSP) / HTML, and processed in the Servlet Container Tomcat.
• Interaction control
Interaction control loads and saves the application data for each query, controls navigation for both online and offline GUI and initiates processing. Furthermore, printing and the ADT mailbox are serviced from here.
This is a pure Java implementation in the form of POJOs (Plain Old Java Objects), using the iPOS framework. There are no distribution restrictions for online and offline use.
The processing is stateful.
• Product logic
All product rules and evaluations, editing of print and EES data etc. are situated in this layer and can be associated with a main product or an individual product. A main product logically superordinates each product, and in particular can also portray cross-divisional product clusters.
There are interfaces to the basic services UniPost, NormRisk, TRIAS, ZÜRS, BLZ, and to mandate control.
The implementation takes place through POJOs (Plain Old Java Objects), so that there are no distribution restrictions for online and offline use.
The products are represented in a tree diagram, where products’ properties are printed above their attributes. Plausibility checks and rules are outlined for each attribute in a meta language and, beyond a certain level of complexity, can alternatively be programmed in Java.
The processing is stateless.
• Contribution Calculator
In this layer, the contribution calculations are carried out in relation to a specific product. This can be completed in various programming languages (Java, C ) or through declarative (VP /MS) approaches.
