En España las micro, pequeñas y medianas empresas (MIPYME) constituyen más del 95% del total de las empresas, en este contexto el objetivo de la investigación fue realizar un análisis de la política fiscal dirigida a la MIPYME de España, atendiendo a los métodos de investigación jurídica se utilizaron dos métodos para la consecución de dos objetivos específicos, se utilizó el método de Dogmática Jurídica para el análisis de las políticas fiscales dirigidas a la MIPYME, que implica el estudio de las contribuciones y regímenes fiscales, el segundo consistió en un análisis estadístico en el municipio de Zaragoza, España.

NOTA INTRODUCTORIA
“Las micro, pequeñas y medianas empresas (MIPYMES) representan en España casi la totalidad del conjunto empresarial español, el 99.88% está constituido por MIPYMES, en el año 2013 el número de MIPYME disminuyó en 52, 282 empresas” (Ministerio de Industria, 2015).
En este contexto el objetivo general de la investigación fue realizar un estudio jurídico de la política fiscal en España, se eligió un municipio que permitió observar el impacto en los empresarios de la política fiscal. La investigación fue exploratoria con enfoque mixto y análisis de datos cualitativos y cuantitativos con un alcance explicativo.
En España existen tres niveles territoriales dotados de autonomía financiera y potestad tributaria, lo cual permite hablar de tres sistemas tributarios diferenciados: El Estatal, el Autonómico y el Local.
“La Constitución Española no atribuye el poder financiero exclusivamente a una sola de las entidades políticas del país, sino que lo distribuye, básicamente, en función de los distintos ámbitos territoriales en que se organiza política y administrativamente el Estado”. Aunado a que la incorporación de España en la Unión Europea en el año 1985 implicó la recepción en el ámbito jurídico interno al ordenamiento jurídico comunitario, o de lo que, en términos más genéricos, se conoce como “acervo comunitario”.
Translation - English Summary
In Spain micro, small and medium-sized enterprises (MSMEs) constitute more than 95% of all businesses. In this context the objective of our research was to carry out an analysis of the fiscal policy of MSMEs in Spain. In order to carry out the judicial research we used two methods to achieve two specific objectives. For the analysis of the fiscal policy applied to MSMEs we used the Juridical Dogmatic method which involves the study of property taxes and fiscal regimes. The second constituted a statistical analysis of the municipality of Zaragoza, Spain.

In this context the general objective of our research was to carry out a judicial study of fiscal policy in Spain. We chose a municipality that allowed us to observe the impact of fiscal policy on business people. Our research was exploratory with a mixed focus and analysis of both qualitative and quantitative data with an explanatory range.
In Spain there are three territorial levels with financial autonomy and tax power, thus allowing us to observe three differing tax systems: the state system, the autonomous system and the local system.
“The Spanish Constitution does not confer financial power exclusively to any one single political entity of the country, but to distinct territorial areas where the state is politically and administratively organised”. However, the incorporation of Spain into the European Union in 1985 meant EU Law being incorporated into the domestic legal system, known in generic terms as “aquis communautaire”.
