Source text - Spanish En los autos caratulados “G. M. F. c/ Auto Generali S.A. y otros s/ Sumarísimo”, el actor apeló la resolución de primera instancia en cuanto imprimió el trámite de juicio ordinario a las presentes actuaciones y dispuso que a los fines de obtener el beneficio litigar solicitado debía ocurrir por la vía prevista en los artículos 78 y siguientes del Código Procesal por cuanto el “beneficio de justicia gratuita” al que alude el artículo 53 de la Ley 24.240 (conf. ley 26.361) solamente alcanza a la eximición del pago de la tasa de justicia.
Los jueces que conforman la Sala D de la Cámara Nacional de Apelaciones en lo Comercial señalaron que de acuerdo al primer párrafo del artículo 53 de la Ley 24.240, en las causas iniciadas por ejercicio de los derechos derivados de la normativa del consumidor “...regirán las normas del proceso más abreviado que rijan en la jurisdicción del tribunal ordinario competente, a menos que a pedido de parte el juez por resolución fundada y basado en la complejidad de la pretensión, considere necesario un trámite de conocimiento más adecuado”.
En base a ello, los Dres. Pablo Damián Heredia, Gerardo Vassallo y Juan Garibotto sostuvieron que “según lo establecido por esa preceptiva de orden público (conf. art. 65, ley 24.240) le corresponde, por regla, el trámite de juicio “sumarísimo” previsto en el art. 321 inc. 3° del Código Procesal, salvo que, a pedido de parte y por resolución fundada, se establezca un trámite más amplio cuando la complejidad del caso así lo amerite”.
Debido a que “en el sub lite no existió tal “petición de parte””, el tribunal juzgó que “ese motivo resulta suficiente, a criterio del Tribunal, para receptar los agravios; pues no corresponde que el magistrado “ordinarice” el proceso por iniciativa propia”, lo cual “lleva a estimar la apelación, con el efecto de otorgar a las presentes actuaciones trámite “sumarísimo”; sin perjuicio de lo que quepa decidir ante la eventualidad de que, oportunamente, exista expresa petición de parte a ese respecto”.
Por otro lado, con relación al alcance que la magistrada de grado atribuyó al “beneficio de justicia gratuita”, los camaristas precisaron que “la materia traída a juzgamiento no es novedosa ni desconocida para este Tribunal, que en reiteradas ocasiones fue llamado a pronunciarse sobre el alcance que corresponde atribuir a la previsión contenida en los arts. 53 y 55 de la ley 24.240 (t.o. según ley 26.361), lo que le permitió exponer numerosos argumentos para finalmente concluir que la frase “beneficio de justicia gratuita” no puede ser considerada sinónimo de “beneficio de litigar sin gastos”, y que solo debe limitarse al pago de la tasa de justicia”.
Translation - English In the case captioned “G. M. F. v. Auto Generali S.A. et al. over Expedited Proceeding,” the plaintiff filed an appeal against the judgment delivered by the first instance court on the grounds that said court applied to this case the rules of regular, non-expedited proceedings and ruled that, in order to request a leave to proceed in forma pauperis1, the plaintiff had to file the complaint according to section 78 et seq. of the Federal Code of Civil and Commercial Procedure since the “leave to file for free” set forth in section 53 of Act No. 24.240 (amended and restated by Act No. 26.361) only provides a waiver of the filing tax.
The Justices of Division D of the Court of Appeals in Commercial Matters in and for the City of Buenos Aires explained that, pursuant to the first paragraph of section 53 of Act No. 24.240, any complaint related to rights stemming from consumer laws and regulations “...will be governed by the rules of procedure for the most expedited proceeding applicable within the venue of the non-federal court with jurisdiction over the matter, unless the judge, upon request by a party, by means of a grounded decision and based on the complexity of the claim, deems it necessary to apply the rules of a more suitable type of proceeding.”
Based on this, Justices Pablo Damián Heredia, Gerardo Vassallo and Juan Garibotto held that “in accordance with the aforementioned public policy provision (pursuant to section 65 of Act No. 24.240), in principle, the expedited proceeding set forth in subsection 3 of section 321 of the Federal Code of Civil and Commercial Procedure should be applied to this complaint, unless the court requires a regular trial to be held, at the request of a party and through a grounded decision, where the complex circumstances of the case so warrant it.”
Since “there was no such ‘request by a party’ in the present case,” the upper court determined that “this is reason enough for this Court to accept the grounds for the appeal, as it is not up to the judge to order, of his own accord, a regular trial,” which “leads us to grant the appeal, such that the rules of expedited proceedings are applied to this complaint, notwithstanding what the judge may decide if a party were to expressly request a regular trial.”
As regards the lower court’s interpretation of the extent of the “leave to file for free,” the upper court explained that “the case at issue here is not one of first impression for this Court, as we have been asked on several occasions to determine the extent of the provisions set forth in sections 53 and 55 (amended and restated by Act No. 26.361), which has allowed us to lay out various arguments and finally conclude that the phrase ‘leave to file for free’ cannot be considered a synonym for ‘leave to proceed in forma pauperis,’ and that it is only limited to a waiver of the filing tax.

La neuralgia del trigémino, también llamada tic doloroso, es una afección dolorosa crónica que afecta al trigémino o 5th nervio craneal, uno de los nervios más largos de la cabeza. El trastorno causa ardor extremo, esporádico y súbito o dolor facial de tipo de shock que dura desde unos segundos hasta 2 minutos por episodio. La intensidad del dolor puede incapacitar física y mentalmente.
El nervio trigémino es uno de 12 pares de nervios craneales que se originan en la base del cerebro. El nervio tiene tres ramas que conducen al cerebro sensaciones de las porciones superior, media e inferior de la cara, al igual que de la cavidad oral. No existe una prueba única para diagnosticar le neuralgia del trigémino. Generalmente el diagnóstico se basa en los antecedentes médicos del paciente y en la descripción de los síntomas, un examen físico, y un examen neurológico minucioso realizado por un médico. Otros trastornos, como la neuralgia post-herpética, pueden causar dolor facial similar, como sucede con los síndromes de cefalea en racimos. La lesión del nervio trigémino (tal vez el resultado de cirugía en los senos paranasales, cirugía oral, accidente cerebrovascular, o trauma facial) puede producir dolor neuropático, que está caracterizado por un dolor sordo, quemante y persistente. Translation - English What is trigeminal neuralgia?
Trigeminal neuralgia, also known as tic douloureux, is a chronic pain condition that affects the trigeminal nerve or fifth cranial nerve, one of the longest nerves in the head. This disorder causes extreme, sporadic, sudden burning sensation or shock-like facial pain that lasts anywhere from a few seconds to up to two minutes per episode. The intensity of the pain can be physically and mentally incapacitating.
The trigeminal nerve is one of 12 pairs of cranial nerves that originate from the base of the brain. The nerve has three branches that conduct sensations to the brain from the upper, middle and lower portions of the face, as well as the oral cavity. The ophthalmic or upper branch provides sensations to most of the scalp, forehead and front part of the head. The maxillary or middle branch connects to the cheeks, upper jaw, top lip, teeth and gums, as well as the sides of the nose. The mandibular, or lower, branch connects to the lower jaw, teeth, gums and bottom lip. More than one nerve branch may be affected by this disorder.
How is TN diagnosed?
There is no single test to diagnose trigeminal neuralgia. Generally, the diagnosis is based on the patient’s medical history and description of symptoms, a physical exam and a thorough neurological examination conducted by a doctor. Other disorders, such as post-herpetic neuralgia, can cause similar facial pain, as it happens with cluster headache syndromes. A trigeminal nerve injury (perhaps as the result of paranasal sinus surgery, oral surgery, stroke or facial trauma) can cause neuropathic pain, which is characterized by dull, burning, persistent pain. Due to the overlapping symptoms and the large number of conditions that can cause facial pain, it is difficult to obtain a correct diagnosis. However, finding the cause of the pain is important since the treatments used for different types of pain may vary.
Most patients with trigeminal neuralgia undergo a magnetic resonance imaging scan in order to rule out a tumor or multiple sclerosis as the cause of their pain. This scan may or may not clearly show a blood vessel compressing the nerve. Magnetic resonance angiography, which can track a dye that is injected into your bloodstream before the scan, can show more clearly any issues with blood vessels as well as any trigeminal nerve compression near the brain stem.
How is TN treated?
Treatment options include medications, surgery and complementary approaches.
Anticonvulsants, used to block the nerve firing, are generally effective for treating trigeminal neuralgia. These medications include carbamazepine, oxcarbazepine, topiramate, clonazepam, phenytoin, gabapentin, pregabalin, lamotrigine and valproic acid.
Tricyclic antidepressants such as amitriptyline or nortriptyline can be used to treat the pain described as constant, burning or dull. Common analgesics and opioids are typically not helpful in treating the sharp and recurring pain caused by trigeminal neuralgia. If medication fails to relieve the pain or causes intolerable side effects such as cognitive disorders, memory loss, excessive fatigue, bone marrow suppression or allergy, then surgical treatment may be suggested.

Source text - English THE CLINICAL PROBLEM
Primary infection with varicella–zoster virus (VZV) results in chickenpox, characterized by viremia with a diffuse rash and seeding of multiple sensory ganglia, where the virus establishes lifelong latency. Herpes zoster is caused by reactivation of latent VZV in cranial-nerve or dorsal-root ganglia, with spread of the virus along the sensory nerve to the dermatome. There are more than 1 million cases of herpes zoster in the United States each year, with an annual rate of 3 to 4 cases per 1000 persons. Studies suggest that the incidence of herpes zoster is increasing. Unvaccinated persons who live to 85 years of age have a 50% risk of herpes zoster. Up to 3% of patients with the disease require hospitalization.
The major risk factor for herpes zoster is increasing age. With increasing time after varicella infection, there is a reduction in the level of T-cell immunity to VZV, which, unlike levels of virus-specific antibodies, correlates with protection against herpes zoster. The risk is higher for women than for men, for whites than for blacks, and for persons with a family history of herpes zoster than for those without such a background. Chickenpox that occurs in utero or early in infancy, at a time when the cellular immune system is not fully mature, is associated with herpes zoster in childhood. Immunocompromised persons with impaired T-cell immunity, including recipients of organ or hematopoietic stem-cell transplants, those receiving immunosuppressive therapy, and those with lymphoma, leukemia, or human immunodeficiency virus (HIV) infection, are at increased risk for herpes zoster and for severe disease.
Postherpetic neuralgia, or pain persisting after the rash has resolved (often defined specifically as pain persisting for 90 days or more after the onset of the rash), is a feared complication of herpes zoster. The pain may persist for many months or even years; it may be severe and interfere with sleep and activities of daily living, resulting in anorexia, weight loss, fatigue, depression, withdrawal from social activities and employment, and loss of independent living. Depending on age and the definition used, postherpetic neuralgia develops in 10 to 50% of persons with herpes zoster. The risk increases with age (particularly after 50 years of age) and is also increased among persons with severe pain at the onset of herpes zoster or with a severe rash and a large number of lesions.
Various neurologic complications have been reported to occur with herpes zoster, including Bell’s palsy, the Ramsay Hunt syndrome, transverse myelitis, transient ischemic attacks, and stroke.
