Appelant appeals from a trial-court order denying his motion for post-conviction DNA testing. Appelant was convicted of capital murder and sentenced to death. On direct appeal, we affirmed his conviction and sentence. XXX v. State, No. XXX (delivered XXX)(not designated for publication). In 2XXX, appellant filed a motion for DNA testing of evidence pursuant to Chapter 64 of the Code of Criminal Procedure. Without conducting a hearing, the trial court denied that motion. Appellant appeals the trial court's denial.

El recurrente apela la decisión emanada del Tribunal de Primera Instancia que deniega su petición para la realización de una prueba de ADN posterior a la sentencia. El recurrente fue declarado culpable de homicidio penado con sentencia a muerte. En apelación directa se confirmó su sentencia y condena. XXX v. State No. XXX [Caso XXX contra el Estado Nº XXX] (emitida el XXX) (publicación no aprobada). En 2008, el recurrente presentó una petición para la realización de una prueba de ADN a la evidencia, de conformidad con el capítulo 64 del Código Procesal Penal del Estado de XXX. El Tribunal de Primera Instancia denegó dicha petición sin celebrar una audiencia por lo que el recurrente apela dicha denegación.

Source text - Spanish "Yo, XXX..., ocurro por ante su competente autoridad a los fines de interponer, como en efecto formalmente interpongo, ACCION DE AMPARO CONSTITUCIONAL, en contra del ciudadano Juez XXX de esta circunscripción judicial, por la grave subversión del proceso en la que ha incurrido, en la demanda por partición de comunidad conyugal intentada por la ciudadana XXX, de la que conoce este Tribunal de Primera Instancia, identificada con el alfanumérico XXX, subversión muy grave que ha ocasionado la VIOLACION de mis derechos constitucionales al debido proceso y a la defence y de mi derecho a recurrir del fallo (derecho a la doble instancia), previstos estos en el artículo 49, numeral 1 de la Constitución XXX, de mi derecho al juez natural, previsto en el numeral 4 del mismo artículo 49 constitucional, violación de mi derecho constitucional a la cosa juzgada, previsto en el artículo 49, numeral 7, del mismo Texto Constitucional, mi derecho constitucional a la seguridad jurídica, derivado de los artículos 2º, 3º, 22 y 49 de la referida Constitución y mis derechos constitucionales de acceso a los órganos de administración de justicia para hacer valer mis derechos e intereses y a la tutela judicial de los mismos, previstos estos en el artículo 24 de la ya mencionada Constitución XXX."
Translation - English "I, XXX, do hereby respectfully address this Court in order to file a Constitutional Remedy against the XXX Trial Judge of XXX of this Judicial District, whose serious subversion of due process in the lawsuit for equitable distribution of marital assets filed by XXX before the aforementioned Trial Court under number XXX, has caused a violation of my rights enshrined in the Constitution of the Republic of XXX, namely: right to due process and legal assistance, right to appeal a judgement, as set forth in article 49(1); right to natural judges, as set forth in article 49(4); right to res iudicata, as set forth in article 49(7); right to legal certainty, as set forth in articles 2, 3, 22 and 49; right to safeguard my rights and interests and their legal protection, as set forth in article 26."
