Source text - English Financials continued to be our largest sector investment and was the worst performer in the portfolio. However, because we have been underweighted in this area, we did not suffer relative to the benchmark. Long term holding, XX, which was a strong fourth quarter performer, had the largest decline in the sector and we used the weakness to rebuild our position. REITs, which we have underweighted for some time, were also underperformers.
Energy stocks rebounded from their fourth quarter underperformance and were the strongest sector in the market. Recently purchased YYY was a top performer as it was the subject of takeover speculation and we trimmed our position as it approached our price target. While we are aware of the possibility of near-term commodity price weakness, we are maintaining our five-year overweighting of this group, as we do not believe stock prices fully reflect the favorable long-term supply/demand equation of oil.
Overall, our portfolio and market outlook essentially has not changed for some time. At the margin, we are finding relatively more opportunities in somewhat larger capitalization stocks as well as reasonably valued growth stocks. However, with the fundamental economic backdrop unexciting, P/E multiples at above average levels and fewer valuation anomalies available, we continue to find it difficult to uncover enough attractive risk/reward situations to replace holdings that have reached our price objectives. Thus we still have above average cash levels as we are not willing to stretch our stringent selection criteria to make investments that have greater risk than reward. As in the past, we will deploy that cash as good opportunities arise. Although this may result in our not fully participating in short term market upswings, we are confident that this longer term focus will continue to deliver above average returns relative to our benchmark.

Source text - English I. I do not find the arguments of the principal parties of particular assistance in approaching the first question. Thus, Pago's claim that its trade mark is well known in Austria, although acknowledged by the referring court, takes the argument no further. It does not explain how one determines what constitutes a substantial part of the Community in general, nor why Austria in particular should be regarded as a substantial part of the Community. Since Tirol Milch argues that national borders are irrelevant, its subsequent analysis (based precisely on such borders) seems to me to be a non sequitur. It leads, moreover, to the (deeply invidious) question of what is a sufficiently important Member State to be considered to be 'substantial'.
2. In broad terms, I find the Commission's analysis a useful starting point.
3. The objective of Article 9(1)(c) is to enable the proprietor of a Community trade mark to protect the exclusive rights conferred thereby against third parties, provided that he can show that his Community trade mark has a reputation in the Community and that the other conditions in Article 9(1)(c) are fulfilled.
4. The Regulation is based on the premiss that the Community trade mark is unitary in character. Indeed, the Community trade mark was created in order to place at the disposal of undertakings 'trademarks enabling the products and services of undertakings to be distinguished by identical means throughout the entire Community, regardless of frontiers'. Against that background, it seems to me that an approach which focuses on Member State boundaries when seeking to establish the extent of a Community trade mark's reputation is fundamentally misconceived. Rather, the starting point must be to consider the territory of the Community regardless of frontiers, as a single and indivisible whole. As a corollary, it is irrelevant whether a reputation exists in one Member State, or any given number of Member States. It is likewise irrelevant whether those Member States are 'big', 'medium-sized' or 'small' (on whatever basis those terms are defined).

Astfel, susţinerea lui Pago potrivit căreia marca sa este de notorietate în Austria, deşi recunoscută de instanţa de trimitere, nu conduce la nicio concluzie. În aceste condiţii, considerăm fundamental eronată o abordare care se concentrează asupra frontierelor statelor membre în încercarea de a stabili întinderea renumelui unei mărci comunitare. Punctul de plecare trebuie să fie, mai degrabă, considerarea teritoriului Comunităţii, indiferent de frontieră, drept un ansamblu unitar şi indivizibil. În consecinţă, este irelevant dacă renumele există într–un stat membru sau într–un anumit număr de state membre. De asemenea, este irelevant dacă acele state membre sunt „mari”, „mijlocii” sau „mici” (indiferent pe ce fundamente sunt definiţi aceşti termeni).
