Source text - Arabic الجريمة إتيان فعل أو تركه عن إرادة جنائية إضراراً بمصلحة اجتماعية حماها المشرع بقواعد تجرمه وتعاقب عليه جزائياً, ويتميز هذا التعريف بأنه قد روعي فيه الجانب الموضوعي والشكلي للجريمة ذلك أن بعض الأفعال تعد من قبيل الأفعال التي حرمت إتيانها ولكنها في حقيقة الأمر لا تعد من قبيل الأفعال المعاقب عليها قانوناً مثال ذلك إزهاق روح إنسان دفاعا عن النفس أو إزهاق روح إنسان بحقها كإعدامه استيفاءً للعقوبة المحكوم بها، فإن إزهاق الروح في ناحيته الشكلية يحقق السلوك المنهي عنه والمجرم بنصوص القانون الجنائي، بينما في حقيقة الأمر لا يعد من قبيل الجرائم المعاقب عليها قانونا لأنها لم تمس المجتمع بأي ضرر لأنها تمت في إطارها الشرعي، كما روعي في التعريف السلوك الايجابي والسلبي المحرم، بجانب شموله للعقوبات والتدابير الاحترازية التي لا تشملها لفظ العقوبة حيث أن الجزاء يشمل العقوبة والتدابير معاً.	Translation - English Crime Committing an act or leaving another out of criminal intention which damages the social interests safeguarded by the legislator through rules criminalize and punish such acts criminally. This definition is characterized by the substantive and formal sides of a crime that some acts are considered prohibited, but in fact they are not legally punishable such as killing a human being in self-defense or killing a human being due to a death sentence. Such a killing formalism implements a forbidden behavior which is offended by the provisions of the Criminal Code, while in fact it is not regarded as crimes punishable by law because it did not cause damage to the community as it has been carried out in its legal formalism. The definition also implies the active and passive forbidden behavior, along with its being inclusive of the sanctions and precautionary measures that are not covered by the punishment wording as the penalty includes punishment and measures altogether.
