La régulation à la mode américaine
17.04.2012
Just as expected? On March 21, the New York Federal Reserve, the U.S. central bank, announced it was postponing, “to an unspecified date", the production of the text needed to transpose, into American law, the new Basel III international banking regulations, supposed to apply to large global banks from 1 January 2013.
Since 2009 Europe has been warning the U.S. not to be tempted to avoid regulations approved by the G20, designed to strengthen bank equity and the security of the global financial system.
There can be no question of the European banks complying with these rules if they are not enforced by the American banks! Even the previous standards from Basel II, from 2004, have not been implemented yet in the United States.
The postponement announced by the Fed is not simply an illustration of how difficult it is to get regulations recognized and enforced across the Atlantic when they have been developed outside American territory, it also highlights the American resistance to the global re-regulation of the financial sector following years of massive deregulation and two major financial crises; the United States in 2008 (the subprime crisis), then Europe in 2010 (the sovereign debt crisis).
THE REALITY IS QUITE DIFFERENT
Indeed, even if the U.S. gives the impression of always leading the way in financial regulation, the reality is quite different. America certainly comes down hard and fast every time there is a crisis or disaster. But there is a huge void between the laws announced by the American administration, the invariably ambitious and comprehensive reforms, and the implementing legislation coming out of Congress.
Trapped in the conflict between Democrats and Republicans, and subjected to constant pressure from powerful financial lobbies, American lawmakers are struggling to agree on reforms. In fact, there has not been a truly major financial reform in the U.S. since 1933! Then the Americans took less than three months to agree on a text (the Banking Act, or Glass-Steagall Act) prohibiting deposit banks from operating as investment banks.
So what is the state of play? Everyone recalls President Barack Obama's offensive, against Wall Street and its financial excesses which, in July 2010, resulted in a major financial reform, the Dodd-Frank law.
Developed two years after the subprime crisis broke out, this text should rein in the financial industry, by making practices more ethical and removing the loopholes in financial regulation. Eighteen months later, it has only been partially implemented. The Fed is still not managing to control large insurers and investment funds effectively.
Worse still, one of the most iconic measures, the famous Volcker rule (named after the former Fed chairman, Paul Volcker, who became an economic advisor to Obama), designed to prohibit certain speculative operations in deposit banks from benefiting from a government guarantee when involved in proprietary trading activity, may well be watered down.

Translation - English Recently identified susceptibility genes for AMD
Study of candidate genes by function – the apolipoprotein Ɛ (ApoƐ) gene
Immunohistochemical studies have reported that apolipoprotein Ɛ (ApoƐ) has been found in drusen in the eyes of AMD patients. ApoƐ not only plays a major part in expelling cholesterol from the retina but is also an important chaperone protein in cell cytoplasm. It was therefore a possible candidate gene and two studies conducted respectively by Souied et al.7 and Klaver et al.8 in 1998 concluded that it was associated with AMD. In both studies the Ɛ4 isoform appears to be protective, with respective odds ratios of 0.34 and 0.43. The protective role of ApoƐ4 in AMD was confirmed by a meta-analysis9. Through re-grouping ten case control studies – 3,288 cases with AMD and 6,908 controls without AMD – this meta-analysis found an odds ratio of 0.67 (95% confidence level, 0 .57 - 0.78) for genotype Ɛ3/Ɛ4. The inability of the Ɛ4 isoform to form dimers and the presence of two positive charges allow this isoform to provide better clearance of cholesterol through the membranes which may partially explain its protective role in AMD. The main limitation of all case-control studies analysing the impact of this gene on AMD is the low frequency of Ɛ2 and Ɛ4 isoforms. This means that large numbers of cases are required for each case group.
The study of genes responsible for hereditary macular diseases - the example of gene ABCA4
To date only the ABCA4 gene (ATP-binding cassette, sub-family A, member 4) has been implicated in the development of retinal dystrophies. This link caused a storm of controversy. It was Allikmets et al - in the first case-control study to compare two sets of 96 and 71 AMD patients respectively with a control group of 220 -. who showed that the D2177N mutation of the ABCA4 gene was more likely to be found in those with AMD (p=0.023).10 However a controversy was sparked when Edwin Stone criticised the statistical methodology Allikmets had used to confirm the gene’s involvement in AMD as well as the imprecision of the control data in the study and the lack of ethnic stratification.11 This led to the formation of an international consortium involving 15 teams across 8 countries 12. It analysed a large number of patients with different forms of AMD - 1,218 in total, of which 553 had the atrophic form and 685 the exudative – and compared them with a control group of 1,258 individuals free of the disease. The G1961E mutation was found in 19 of the 1,218 patients (1.56%) and 4 of the 1,258 controls (0.32%). The relative risk of developing AMD for carriers of this mutation was 5.2 (95% confidence level 1.7 to 22). Similarly the D2177N mutation was found in 21 of the 1,189 patients analysed (1.77%) and 8 of the 1258 controls (0.64%) (p=0.014). The relative risk of developing AMD for carriers of this mutation was 2.6 (95% confidence level, 1.1 - 7.0). The hypothesis that certain variants of the ABCA4 gene are susceptibility factors which predispose individuals to AMD was therefore confirmed by the international consortium.
The study of candidate genes by position
The complement factor H gene (CFH)
Complement factor H plays a major role in regulating the complement cascade. This serum glycoprotein, consisting of 20 repeats, each of 60 amino acids, regulates the alternative pathway of the complement system in the liquid and cell-bound phases. This route of the complement cascade is characterised by a basal level of activation. The factor H gene is located in 1q32, in a region included in several genetic linkage studies. The genetic polymorphism involved in AMD results in a tyrosine-histodine protein change at amino acid 402 (Y402H). This change to the protein’s structure weakens its affinity to the C reactive protein (CRP) attached to the cytoplasmic membranes. In turn this reduces the alternative complement pathway’s immunoprotective function. This is the CFH region which binds to both heparin and CRP suggesting therefore that changes to the amino acid may to some extent alter how the process of inflammation is regulated within the retina. The malfunctioning of the alternative complement pathway can lead to fragments of C3a and C5a being released and to C5b9 complex being formed which can activate endothelial cells and release growth factors such as VEGF (vascular endothelial growth factor) or bFGF (basic fibroblast growth factor). The presence of small amounts of the complement components in choroidal neovascular membranes and in drusen supports this theory.13 In addition the accumulation of lipids in Bruch’s membrane creates a chronic inflammatory stimulus and provides a substrate for the formation of drusen 14. The concentration of this pro-inflammatory material could induce white cell chemotaxis through the activation of the complement cascade.
The first genome-wide studies and case-control studies show an association between the variant Y402H gene and AMD15. Other case-control studies published subsequently have confirmed that this variant of CFH is a susceptibility factor in various clinical forms of AMD and in different populations16. Such an association however is not found in Japanese patients, probably due to the fact that the allele frequency of the variant responsible is much rarer. The discovery of this susceptibility factor could suggest that the development of new forms of treatment to modulate inflammation may be the pathophysiological substrate for the disease. A meta-analysis of the involvement of the Y402H polymorphism in the CFH gene showed that the odds ratios of developing AMD for heterozygous and homozygous patients were 2.5 and 6.32 respectively.
As with CFH, other factors involved in the complement cascade could also be implicated in the development of the disease. Indeed studies show that genetic variants of factor B as well as the C2 and C3 complement components are associated with AMD. The results of these studies are shown in Table 1.
