Antecedentes del litigio 1 El 10 de noviembre de 2003, el Sr. RahmiÖzdemir, la parte demandante, presentó una solicitud de registro de marca comunitaria en la Oficina de Armonización del Mercado Interior (Marcas, Dibujos y Modelos) (OAMI) con arreglo al Reglamento (CE) nº 40/94 del Consejo, de 20 de diciembre de 1993, sobre la marca comunitaria (DO 1994, L 11, p. 1), en su versión modificada [sustituido por el Reglamento (CE) nº 207/2009 del Consejo, de 26 de febrero de 2009, sobre la marca comunitaria (DO L 78, p. 1)], reivindicando la prioridad de la marca alemana Nº 303 26 412.8 presentada el 24 de mayo de 2003.
