Source text - English 1. The rules and procedures of this Understanding shall apply subject to such special or additional rules and procedures on dispute settlement contained in the covered agreements as are identified in Appendix 2 to this Understanding. To the extent that there is a difference between the rules and procedures of this Understanding and the special or additional rules and procedures set forth in Appendix 2, the special or additional rules and procedures in Appendix 2 shall prevail. In disputes involving rules and procedures under more than one covered agreement, if there is a conflict between special or additional rules and procedures of such agreements under review, and where the parties to the dispute cannot agree on rules and procedures within 20 days of the establishment of the panel, the Chairman of the Dispute Settlement Body provided for in paragraph 1 of Article 2 (referred to in this Understanding as the “DSB”), in consultation with the parties to the dispute, shall determine the rules and procedures to be followed within 10 days after a request by either Member. The Chairman shall be guided by the principle that special or additional rules and procedures should be used where possible, and the rules and procedures set out in this Understanding should be used to the extent necessary to avoid conflict.
Article 2: Administration
1. The Dispute Settlement Body is hereby established to administer these rules and procedures and, except as otherwise provided in a covered agreement, the consultation and dispute settlement provisions of the covered agreements. Accordingly, the DSB shall have the authority to establish panels, adopt panel and Appellate Body reports, maintain surveillance of implementation of rulings and recommendations, and authorize suspension of concessions and other obligations under the covered agreements.

Die Richtlinien und Verfahren dieses Übereinkommens gelten vorbehaltlich solcher besonderer oder zusätzlicher Richtlinien und Verfahren zur Streitbeilegung, die in den in Anhang 2 zu diesem Übereinkommen als erfasst identifizierten Verträgen enthalten sind. Soweit eine Differenz zwischen den Richtlinien und Verfahren dieses Übereinkommens und den in Anhang 2 aufgeführten besonderen oder zusätzlichen Richtlinien und Verfahren besteht, haben die besonderen oder zusätzlichen Richtlinien und Verfahren in Anhang 2 Vorrang. Sollte in Streitigkeiten, die die Richtlinien und Verfahren von mehr als einem erfassten Vertrag betreffen, ein Widerspruch zwischen den besonderen oder zusätzlichen Richtlinien und Verfahren solcher zu überprüfender Verträge bestehen, und sollten sich die Streitparteien nicht innerhalb von 20 Tagen ab der Formierung eines Gremiums auf Richtlinien und Verfahren geeinigt haben, wird der Vorsitzende des Streitbeilegungsgremiums, welches in Paragraf 2, Absatz 1 bestimmt ist (in diesem Übereinkommen “SBG” genannt), in Abstimmung mit den Streitparteien die zu befolgenden Richtlinien und Verfahren innerhalb von 10 Tagen nach dem Gesuch eines der Mitglieder festlegen. Der Vorsitzende hat dem Grundsatz zu folgen, dass besondere oder zusätzliche Richtlinien und Verfahren so weit wie möglich anzuwenden sind und dass die in diesem Übereinkommen dargelegten Richtlinien und Verfahren anzuwenden sind, soweit dies zur Vermeidung einer Auseinandersetzung notwendig ist.
Paragraf 2: Verwaltung
1. Das Streitbeilegungsgremium wird hiermit zur Verwaltung dieser Richtlinien und Verfahren gebildet sowie zur Verwaltung der Beratungs- und Streitbeilegungsregelungen der erfassten Verträge, es sei denn, etwas Anderes ist in einem erfassten Vertrag bestimmt. Demgemäß ist das SBG befugt, Gremien zu bilden, Berichte von Gremien und Berufungskomitees anzunehmen, die Überwachung der Umsetzung von Entscheidungen und Empfehlungen aufrechtzuerhalten und die Aussetzung von Konzessionen und anderen, sich aus den erfassten Verträgen ergebenden, Verbindlichkeiten zu genehmigen.
