Source text - German Eine der tragenden Säulen der Europäischen Gemeinschaft ist der Binnenmarkt. Dieser zeichnet sich durch seine Grundfreiheiten aus, also durch die vier Freizügigkeiten der Waren, der Dienstleistungen, des Kapitals und der Personen, wobei letztere binnenmarktrelevant wiederum in die Freizügigkeit der Arbeitnehmer und in die Niederlassungsfreiheit aufzuteilen ist. Es versteht sich von selbst, dass diesen im EG - Vertrag, also im so genannten Primärrecht, geregelten Grundfreiheiten auf Grund des Gedankens der Freizügigkeit schon systemimmanent ein gewisser Grad an Liberalisierung innewohnt.
Zur weiteren Verwirklichung des Binnenmarktes können im Bereich der Dienstleistungen gemäß Art. 52 Abs. 1 EG noch einzelne, detailliertere Sekundär-Rechtsakte, nämlich „ Richtlinien zur Liberalisierung einer bestimmten Dienstleistung“ erlassen werden. Davon ist z.B. 2006 mit der Verabschiedung der „Richtlinie 2006/123/EG über Dienstleistungen im Binnenmarkt“ Gebrauch gemacht worden, wobei es allerdings noch nicht zu einer vollständigen Harmonisierung und Liberalisierung kam, da u.a. das Herkunftslandprinzip, also die Geltung des „Heimatrechts“ bei der Erbringung einer Dienstleistung in einem anderen EG – Mitgliedsland, (noch) nicht durchgesetzt werden konnte. Auch sind aus dieser allgemeinen Dienstleistungsrichtlinie damals 2 Bereiche explizit ausgenommen worden: Die Gesundheits- Dienstleistungen und die Glücksspiele.
Für die Gesundheitsdienstleistungen ist im Juli 2008 ein eigener Richtlinien - Entwurf vorgelegt worden. Dies war notwendig, weil Großbritannien u.a. – wegen der besonderen Finanzierung seines Gesundheitssystems über Steuern und nicht wie in den anderen Ländern durch Kassenbeiträge der Patienten – Bedenken hat, Gesundheitsdienstleistungen, die im Ausland (noch zudem unter Umgehung der inländischen Wartezeiten) in Anspruch genommen werden, durch Steuern zu finanzieren.
Translation - Portuguese Um dos pilares fundamentais da Comunidade Europeia é o mercado comum. Este distingue-se pelas suas quatro liberdades, ou seja, a liberdade de circulação de bens, de serviços, de capitais e de pessoas, sendo que por sua vez a última reparte a sua relevância em termos de mercado único pela livre circulação de trabalhadores e pela liberdade de estabelecimento. À luz da ideia de livre circulação, é evidente que inere a estas liberdades reguladas no Tratado da Comunidade Europeia (TCE), ou seja, no chamado direito primário, um certo grau de liberalização.
Para a concretização do mercado único, e ao abrigo do Artigo 52.º,1 do TCE podem ser adoptados instrumentos jurídicos de direito secundário mais direccionados e pormenorizados, em particular “Directivas para a liberalização de uma determinada actividade ou serviço”. Do exercício desse recurso tome-se como exemplo o ano de 2006, com a aprovação da “Directiva 2006/123/CE relativa aos serviços no mercado interno”, ainda que não se tenha chegado a uma harmonização e a uma liberalização integrais, já que, entre outras coisas, o princípio do país de origem, ou seja, a aplicação do “direito do país de origem” à prestação de um serviço noutro estado-membro da Comunidade Europeia, não pôde (ainda) ser aplicada. Mais a mais, duas matérias foram ao tempo explicitamente excluídas desta directiva genérica sobre prestação de serviços: a prestação de serviços de saúde e os jogos de azar.
Quanto à prestação de serviços de saúde, em Julho de 2008 foi apresentada uma proposta de directiva específica para esta matéria. Isso foi indispensável, uma vez que o Reino Unido, entre outros, por causa do financiamento especial do seu sistema de saúde a partir de impostos e não como em outros países através das contribuições dos pacientes, tem objecções quanto à prestação de serviços de saúde efectuada no estrangeiro (sobretudo no decorrer de listas de espera internas) ser considerada pretensão passível de financiamento por dinheiro dos impostos.

I am a Portuguese jurist and I hold a bachelor in Law (JD), awarded by the New University of Lisbon, Portugal. I've studied for a year in the University of Munich, Germany, as an exchange student, and I had the opportunity to attend several courses in its Applied Languages Centre (Fachsprachenzentrum), such as Financial Markets, Torts and Constitucional Law, American Legal Terminology, Business English for Negociations and Spanish Law. I've also attended a Legal English course in the British Council Lisbon.
I was one of the founding members and the first director of PRAXIS Mooting, an association created to promote moot court competitions among portuguese Law students. I competed in the Philip C Jessup Moot Court Competition and in the European Law Moot Court and in 2005 ago I was coach of the portuguese team that was selected to compete in the international rounds of the Jessup Moot Court, in Washington, D.C.
I have done an internship at the Legal Department of the German-Portuguese Chamber of Commerce, in which I had the opportunity to work in a multilingual environment (areas of expertise: Company Law, International and Portuguese Tax Law and Intellectual Property Law). I have also worked in the Festival junger Künstler Bayreuth (Bayreuth Festival of Young Artists), Germany, in its 2008 edition, in order for me to get acquainted with the field of arts management.
I'm currently a legal intern at the Portuguese Ministry of Justice, International Affairs Department. Main activities and responsibilities: advisory on legal aspects of the European area of freedom, security and justice, on the Portuguese procedural rules of private international law from the perspective of EU law and public international law and on issues concerning human rights within the area of justice. Preparation of the visits to Portugal of foreign government delegations in the field of justice. Organization of a conference on human rights and the universal jurisdiction. This traineehsip has been obtained through PEPAC, a national competitive process organized by the Portuguese Government.
