Methods
In this multicenter, double-blind, randomized trial, we compared ticagrelor (180-mg loading dose, 90 mg twice daily thereafter) and clopidogrel (300-to-600-mg loading dose, 75 mg daily thereafter) for the prevention of cardiovascular events in 18,624 patients admitted to the hospital with an acute coronary syndrome, with or without ST-segment elevation.

1 Einleitung

Angebot bedeutet die Veröffentlichung einer eigenverantwortlich ausgestalteten Darstellung zur Veräusserung eines Produkts auf dem Marktplatz myExclusiv.
1.3.3 Angebotsart auf dem myExclusiv-Marktplatz
Sämtliche Angebote sind als Anzeigen oder Inserate zu verstehen.
Mit einer Anzeige oder einem Inserat sucht der Verkäufer nach einem Interessenten für sein im Angebot genanntes Produkt. Die Bedingungen der Veräusserung brauchen noch nicht definitiv festzustehen. 2.2 Mindestvoraussetzungen der Benutzer

3.2 Immaterialgüterrechte Dritter (Geistiges Eigentum)

Die Einstellgebühr ist per sofort und ohne Skontoabzug fällig und wird per E-Mail in Rechnung gestellt. Solange die Gebühr nicht überwiesen ist, wird die Aufschaltung des Inserates verzögert.
Eine Löschung oder Änderung eines Angebots während seiner Laufdauer durch den Verkäufer berechtigt diesen nicht zur Rückerstattung oder Reduktion der angefallenen Gebühren.

MyExclusiv haftet nur für direkte Schäden, die durch eine vorsätzliche oder grobfahrlässige eigene Handlung von myExclusive entstehen. Eine Haftung von MyExclusiv für direkte Schäden bei leichtem Verschulden – gleich aus welchem Rechtsgrund – ist unter Vorbehalt zwingender gesetzlicher Bestimmungen ausdrücklich ausgeschlossen.
6.2 Technische Störungen, Wartung

• die wahrheitsgemässe und sonst korrekte Ausgestaltung von Angeboten
• die Qualität, Sicherheit, Legalität oder Verfügbarkeit angebotener Produkte
• die Fähigkeit, die Befugnis und den Willen des einzelnen Mitglieds hinsichtlich Anbieten, Kauf, Lieferung, Bezahlung oder sonstiger Vertragserfüllung.
6.4 Mitglieder und Dritte

With a bulletin or an advertisement the seller searches for an interested party for the product being offered. The conditions for sale need not be finalised yet. The advertisement only serves as a mediation tool for establishing a contact with an optional price tag. The negotiation of the conditions and the fulfilment of the contract occur by direct contact between the seller and buyer, and therefore outside of the myExclusiv market place. The advertisement or the bulletin is therefore, if nothing else is mentioned, a non-binding negotiation base.
2 Use of the website
2.1 Objective
Prerequisite for the offering of products on myExclusiv and the use of the herewith combined website functions is the registration as a user. The purchasing of a product does not require any registration, since this is only a contact agency, purchasing requirements and contract fulfilment occur in direct contact between the seller and the buyer, outside of the myExclusiv market place.
2.2 Minimum requirements for users
2.2.1 Capacity to act
Unrestricted membership is only open to fully capable natural and legal persons. From membership excluded are minors (persons under the age of 18).
2.2.2 Exclusion on myExclusiv
myExclusiv is authorised to exclude a user on objective grounds, especially in violation of the general terms and conditions (thus he has no more rights to advertise his products), without that the respective member may start to make any claims against myExclusiv.
3 General membership obligations
3.1 Technical interventions
The use of any mechanisms, software or other scripts which may impair the proper functioning of the website is prohibited.
3.2 Intellectual property rights of third parties (Intellectual Property)
Offers, texts and pictorial representations which a member in any way or form (offer descriptions, evaluations, entries within the framework of the „question and answer-function“, etc.) publishes or communicates in any other way over the myExclusiv website, are in any way not allowed to violate intellectual property rights of third parties. The member is only permitted to use and publish pictures and texts which he has either created himself or where the rights holder has given his consent to use them, this is valid in particular also for text and pictorial materials which are publicly accessible on other websites.
3.3 Personal rights of third parties
Offers, texts and pictorial representations which a member publishes or communicates (offer descriptions, evaluations, entries within the framework of the „question and answer-function,“ etc.) in any other form over the myExclusiv website are not allowed in any way or form to violate the personal rights of third parties, in particular they are prohibited to be insulting, obscene, defamatory, harassing, injurious, denigrating, lowering, reputation damaging etc.
3.4. Use of contents
Information in connection with a seller or other information which myExclusiv transmits in combination with offers is only allowed to be used in combination with the respective offer; in particular the use for marketing purposes is strictly prohibited. Furthermore it is not permitted to misuse this information for the mailings of newsletters or hand over to third parties.
4 Market place operation
4.1 Offers
myExclusiv is authorised at any time by its own judgment to prohibit the offering of certain products and product groups on the market place without stating any reason.
5 Seller obligations
5.1 Available power over the offered product
The seller may only offer products for which he is authorised. This means that the member is fully capable and unencumbered to transfer the ownership of the product over to the seller; thus is eligible and entitled. That he is entitled to the renting of an object, and that he is entitled to transfer the right.
5.2 No selling of prohibited products
It is prohibited to offer products whose offers, sale, purchase, dispensing or using could infringe on legal regulations or good morals. myExclusiv checks prior to publishing the contents of the advertisement whether it adheres to the general terms and conditions and if it violates the terms of insertion. With illegal goods myExclusiv reserves the right to notify the authorities or any injured third parties.
5.3 Truthful and complete information about the goods
The seller is obligated to provide truthful, non-misleading, and not unfair information about the offered product and fully to inform about the details of the payment and delivery. All defects of the product and of the packaging shall be indicated. This applies in particular also for used or damaged packaging products.
5.4 Price and terms of payment
myExclusiv charges a listing fee to the seller for offering products on the website of myExclusiv.com. The current fees are published online on myExclusiv.com. myExlcusiv reserves the right at any time to adjust the fees for new services.
The listing fee is due with immediate effect and without discount and will be sent by e-mail for billing. As long as the fee has not been paid, the activation of the advertisement will be postponed.
Deleting or editing of an offer by a seller during the run time does not permit him to ask for a refund or a discount of the accumulated fees.
The fees include providing the ordered services according to the description under myExclusiv.
Additional services are billed separately according to agreement with the client.
Accepted methods of payment are: Visa, MasterCard, PostCard.
6 Disclaimers of myExclusiv.com
6.1 General terms
The use for offered services on myExclusiv is at the own risk of the customer. myExclusiv does not assume any liability for any damages arising through the deployment or transferring of files or other information on the internet.
myExclusiv shall only claim liability for direct damages resulting from an intentional or grossly negligent act. A liability of myExclusiv for direct damages for slight negligence – irrespective of the legal reason – is subject to mandatory statutory provisions and expressly excluded.
6.2 Technical disturbances, maintenance
myExclusiv is not liable for inaccessibility of the website, malfunctioning of individual or whole website functions or non-availability of the website.
The website can be inaccessible or only partially accessible from time to time for maintenance work or other reasons, without the user, respectively, the member raising any claims against myExclusiv.
6.3 Contents and offers
myExclusiv is not required for checking the offers, and other information published from other members on the market place and does in no way assume responsibility for:
• Truthful and otherwise correct publishing of products
• The Quality, safety and compliance or other availability of the offered products
• The Ability, the authorisation and the will of the individual member regarding offers, purchase, delivery, payment and other contractual fulfilments.
6.4 Members and third parties
myExclusiv does not claim liability , in particular for damages which members or third parties suffer through the behaviour of other members or third parties in combination with the use or abuse of the myExclusiv website. myExclusiv makes no warranties and guarantees for the goods and services offered as well as the possibly resulting contracts, such as contracts of sale.
7 Applicable law and jurisdiction
All standing in connection with these Terms and any disputes between myExclusiv (current or former) users are subject to the Swiss law. The location of jurisdiction is 1712 Tafers, Switzerland.
8 Severability clauses
Should individual provisions of these terms and conditions be wholly or partially void and / or unenforceable, the validity and / or validity of the remaining provisions or parts of such provisions remain. The invalid and / or ineffective provisions shall be replaced by those economically to the meaning and purpose of the invalid and / or ineffective provisions in a legally effective manner.
