1- اعتبار ميعاد الطعن بالنقض ثلاثون يوماً من تاريخ اليوم التالي لاعلان الحكم أو العلم اليقيني به.
2- للحكم الجزائي حجية في الدعوى المدنية المنظورة امام المحكمة المدنية بما مفصول فيه من اساس مشترك بين الدعويين.
3- عدم جواز التمسك امام المحكمة المدنية باستغراق خطأ المضرور لخطأ الفاعل لمخالفة ذلك حجية الحكم الجنائي البات الصادر بالادانة عن الاصابة الخطأ.
4- سلطة محكمة الموضوع في استخلاص مدى مساهمة المضرور في الخطأ شرط اقامة قضائها على اسباب سائغة لها اصلها الثابت في الاوراق.
5- وجوب الدية بتفويت منفعة الجنس وتفويت الجمال على الكمال اما الارش فثابت بتفويت بعض منفعة الجنس.
6- جواز تعدي التعويض مقدار الدية كون حكومة العدل غير معتبرة جزءاً من الدية.
7- وجوب القضاء بديات أو اروش متعددة بالرغم من اتحاد الفعل المسبب لكل منها وذلك في حال تعدد الاعضاء المفقودة.
8- سلطة محكمة الموضوع في تحصيل فهم الواقع في الدعوى وتقدير الادلة ومنها التقارير الطبية شرط اقامة قضائها على اسباب سائغة لها اصلها الثابت في الاوراق.
9- اعتبار عدم تحديد الشرع دية للعجز الدائم في القدرة على البطش ودفع الاذى والدفاع عن النفس امتناعاً للقضاء عنه بالدية لعدم وجود قياس في المعاني ولعدم تمتعه بالذاتية المستقلة المبررة للتعويض عنه.
10- سلطة محكمة الموضوع في تقدير التعويض الجابر للضرر شرط اقامة قضائها على اسباب سائغة كافية لحمله طالما لا نص قانوني ملزم اتباع معايير معينة اضافة إلى جواز احتساب الكسب الفائت كعنصر من عناصر الضرر المادي.

1. Consideration of the date of challenge by cassation 30 days as of date of next day to pronouncement of judgment or undoubted knowledge thereof.
2. Penal judgment has res judicata in civil cases heard by civil court in matters decided, on mutual grounds, between the two cases.
3. Impermissibility of upholding, before civil court, to elimination of the error of the damaged to the error of the damaging, for breach of the res judicata of the conclusive penal judgment rendered in indictment of the unintended injury.
4. Jurisdiction of the trial court to decide on the extent of contribution of the damaged to the error; provided establishing such decision on valid reasons as evidenced in papers.
5. Necessity of blood money for loss of benefit of sexual ability and loss of comeliness over bodily completeness.
6. Permissibility of compensation to exceed the amount of blood money due to inconsideration of unstipulated remedy as part of blood money.
7. Necessity of granting various blood monies or partial blood monies in spite of oneness of the act causing each of them, that in the event of multitude of missing organs.
8. Jurisdiction of trial court to form understanding of the merits of the case and to assess evidence, including medical reports, provided that judgment is based on valid reasons evidenced by documents.
9. Consideration of Sharia not defining blood money for permanent impairment of capability of inflicting harm and preventing damage and self defense as abstention from specifying certain blood money due to the existence of semantic conflict and for permanent impairment not holding independent subjectivity justifying compensation therefor.
10. Jurisdiction of trial court to assess compensatory damages, provided establishing same upon valid reasons sufficient for substantiation, as long as there is no binding legal text as to adherence to certain criteria in assessment, in addition to permissibility of counting for the loss of gains as an element of material damage elements.
