The United States District Court for the Middle District of X presents its greetings to the judicial authorities of the Federal Republic of Germany and respectfully requests the assistance of the courts of the Federal Republic of Germany in connection with a criminal matter. The United States District Court for the Middle District of X assures the courts of the Federal Republic of Germany and the appropriate judicial authority designated to execute this request that the courts of the United States are authorized to assist foreign tribunals in the executions of letters rogatory for assistance in criminal matters. This Court also provides assurances that the physical evidence requested herein would be obtained pursuant to a compulsory order issued by this Court, i.e. a grand jury subpoena, if such evidence were located within the jurisdiction of this court and that the rights of third parties will not be impaired.
FACTS
Six foreign nationals were indicted by a federal grand jury on August 22, 1996, for violating United States criminal laws by participating in a conspiracy to smuggle reptiles into the United States. United States v. Smith et al. Two of the six persons indicted have been arrested in the United States and have pled guilty to charges related to wildlife smuggling. The United States Attorney, who is the federal prosecutor for this district, and the Environment and Natural Resources Division of the United States Department of Justice, are now investigating additional alleged violations of United States criminal laws, primarily by citizens of the United States who purchased smuggled animals from those already indicted.

Окружной суд Соединенных Штатов по Среднему округу X приветствует судебные органы Федеративной Республики Германия и с почтением обращается за содействием к судам Федеративной Республики Германия в отношении уголовного дела. Окружной суд Соединенных Штатов по Среднему округу X уверяет суды Федеративной Республики Германия и соответствующие судебные органы, уполномоченные для выполнения данного обращения, в том, что суды Соединенных Штатов имеют полномочия содействовать зарубежным судебным учреждениям в выполнении судебных поручений в целях содействия при расследовании уголовных дел. Данный Суд также предоставляет гарантии того, что запрашиваемые вещественные доказательства будут получены в соответствии с обязательным ордером, выданным этим Судом, т.е. повесткой на заседание большого жюри, при условии, что эти доказательства подпадают под юрисдикцию этого суда, и не будут ущемляться права третьих сторон.
ОБСТОЯТЕЛЬСТВА
22 августа 1996 г. большим жюри федерального суда было предъявлено обвинение шестерым иностранным гражданам в нарушении уголовного законодательства Соединенных Штатов, а именно - участии в организации контрабанды рептилий на территорию Соединенных Штатов. Соединенные Штаты против Г-на Смита и других. Двое из шестерых лиц, которым предъявлено обвинение, были задержаны в Соединенных Штатах и признали себя виновными в отношении обвинений в контрабанде объектов дикой природы. Федеральный прокурор Соединенных Штатов, который является федеральным обвинителем в этом округе, и Отдел природных ресурсов и экологии при Министерстве юстиции Соединённых Штатов в данный момент расследуют дополнительные предполагаемые нарушения уголовного законодательства Соединённых Штатов, в основном жителями Соединённых Штатов, которые приобрели контрабандных животных у ранее обвиненных лиц.

Source text - Ukrainian 1. ПРЕДМЕТ ДОГОВОРУ
1.1. Комісіонер зобов'язався за дорученням Комітента, але від свого імені, за комісійну плату, зробити одну або декілька операцій, необхідних для передачі Комітентові Приміщення, отриманого в результаті виконання Договору.
Майно придбане комісіонером за рахунок комітента, є власністю комітента(ст.1018 ГКУ).
1.2. Характеристика Приміщення приведена в Додатку № 1 до Договору.
2. СУМА ДОГОВОРУ, КОМІСІЙНА ПЛАТА І ПОРЯДОК РОЗРАХУНКІВ
2.1. Сума Договору, терміни та умови оплати приведені в Додатку № 3 до Договору.
2.2. В суму Договору входить відшкодування Комітентом всіх витрат Комісіонера, пов'язаних з виконанням цього Договору, а також комісійна плата.
2.3. Оплата за Договором виконується шляхом перерахування Комітентом грошових коштів на поточний рахунок Комісіонера.
2.4. За виконання Комісіонером доручення Комітента за Договором встановлена комісійна плата у розмірі 10% від суми Договору з врахуванням ПДВ.
2.5. Виплата комісійної плати виконується шляхом самостійного утримання Комісіонером тих, що належать йому грошових коштів з суми кожного платежу, здійсненого Комітентом.
3. ПРАВА І ОБОВ'ЯЗКИ СТОРІН
3.1. Комісіонер зобов'язаний:
3.1.1. Самостійно спланувати і організувати виконання комплексу заходів, необхідних для виконання доручення Комітента.
3.1.2. Укладати необхідні договори з третіми особами, розробляти розрахунки, пов'язані з виконанням Договору.
3.1.3. Здійснювати контроль якості і термінів виконання договорів, укладених відповідно до п.п. 3.1.2 Договору.
3.1.4. Нести відповідальність перед Комітентом по договорах, укладених відповідно до п.п.
3.1.2. Договору.
3.1.5. По запиту Комітента надавати інформацію про виконання Договору.
3.1.6. Передати Комітентові по Акту приймання-передачі Приміщення в порядку, передбаченому Додатком № 2 до Договору .Надати Комітенту Звіт про виконання Договору в порядку, встановленому в Додатку № 2 до Договору.
3.2. Комісіонер має право:
3.2.1. Утримати комісійну плату у розмірі 10% від суми грошових коштів, наданих Комітентом для виконання доручення за Договором.
3.2.2. Вимагати від Комітента належного виконання обов'язків за Договором.
Translation - English 1. SUBJECT OF AGREEMENT
1.1. Commission agent undertook on the basis of Committent's power of attorney but on his own behalf and for a commission fee, to perform one or several transactions required for transfer of the Premises received through the execution of the agreement to the Committent.
The property acquired by the commission agent at Committent's expense is considered to be owned by Committent (article 1018 of Civil code of Ukraine (CCU)).
1.2. Description of Premises is specified in Annex No. 1 of the Agreement.
2. AMOUNT OF AGREEMENT, COMMISSION FEE AND PAYMENTS PROCEDURE
2.1. Amount of Agreement, payment terms and conditions are specified in Annex No. 3 of the Agreement.
2.2. Amount of Agreement includes compensation by the Committent of all expenses that are associated with this Agreement execution and incurred by the Commission agent as well as payment of commission fee.
2.3. Payment according to the Agreement is performed via transfer by Committent of money on the current account of Commission agent.
2.4. An established commission fee for performance of Committent's assignment by Commission agent is equal to 10% of the amount of Agreement including VAT.
2.5. Settlement of commission fee is carried out via independent deduction by Commission agent of money that belong to him from the sum of each payment performed by Committent.
3. RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1. Commission agent is obliged:
3.1.1. To plan and organize independently performance of complex of measures required for execution of Committent's assignment.
3.1.2. To conclude necessary treaties with third parties, produce compensations associated with Agreement execution.
3.1.3. To exercise control over quality and terms of execution of treaties concluded in accordance with subclause 3.1.2 of the Agreement.
3.1.4. To be responsible before Committent as per treaties concluded in accordance with subclause
3.1.2. of the Agreement.
3.1.5. To provide upon Committent's request information about Agreement execution.
3.1.6. To transfer to the Committent the Premises on the basis of Delivery and Acceptance Act according to the procedure specified in Annex No. 2 of the Agreement. To provide the Committent with Report about Agreement execution according to the procedure specified in Annex No. 2 of the Agreement.
3.2. Commission agent has a right:
3.2.1. To deduct a commission fee in the amount of 10% from the sum delivered from Committent for execution of assignment under the Agreement.
3.2.2. To demand from the Committent proper performance of his obligations under the Agreement.
