• دور الشرطة هو التحقيق وجمع الأدلة. دور النيابة العامة يتجلى في النظر في الأدلة وتقديم المشورة للشرطة بخصوص توجيه أو عدم توجيه الإتهام في حالة طلبهم لذلك.
•بعد أن يتم الإتهام من قبل الشرطة، تأتي وظيفة النيابة العامة لتقرر فيما إذا كانت ستستمر في المحاكمة
•على النيابة العامة بالمثل أن تقرر ما إذا كان توجيه الاتهام للمدعى عليه قد تم بشكل صحيح، وأن تعدل التهم في المحكمة عند الضرورة.
•إذا لاحظت الشرطة أن هناك تاريخا طويلا من العنف العائلي من قبل نفس الجاني والضحية ، فإنها تسلط الضوء على هذه النقطة للنيابة العامة التي بدورها قد تستمر بالمحاكمة حتى لو كانت الضحية تطلب عكس ذلك.
• النيابة العامة هي التي تقوم بتقديم قضية الضحية في المحكمة لمصلحة المجتمع ككل. ليس على الضحية دفع ثمن هذه الخدمة ولكن لايشارك عادة أي محامين في القضية حتى يوم المحاكمة.
Translation - English The role of the Crown Prosecution Service
•It is the role of the Police to investigate and to gather evidence. It is the role of the CPS to consider the evidence and to provide Police with advice, if they ask for it, as to whether or not to charge.
•Where the Police have already charged, it is the CPS’s job to decide whether or not to continue the prosecution.
•Similarly the CPS must decide if the defendant has been charged correctly and will amend charges at Court as necessary.
•If there the Police highlight that there is a long history of domestic violence involving the same perpetrator and victim, they will highlight this to CPS who may decide to continue with a prosecution even if the victim asks them not to.
•It is the CPS who present the victim’s case in Court in the interests of society as a whole. The victim does not have to pay for this service but usually does not meet any of the lawyers involved in their case until the day of trial.
