Grant of Probate
When a person makes a Will they appoint an Executor to administer their estate when they die. The Executor will have power to sell, encash or transfer assets belonging to the person who has died (the Testator) and to pay funeral expenses, debts and liabilities of the Testator. Generally speaking, if the Testator leaves assets worth more than £5,000 these will be released to the Executor on sight of a Grant of Probate. This is an Order of the High Court of Justice and confirms the authority of the Executor to administer the Testator’s property in England and Wales.
Grant of Letters of Administration With Will Annexed
A person (the Testator) may have made a valid Will but failed to appoint an Executor. The Executor may have died before the Testator or be unable to act due to ill health, old age or lack of mental capacity. He may decide he does not want to act and will renounce his office. A simplified order of priority of those people who are entitled to take out a Grant of Letters of Administration with Will annexed is set out below.
A person who holds a residuary gift in the Will on trust for someone else e.g. where the Will contains a gift of the remainder of the Testator’s estate to A and B in trust for C and D, then A and B will have first priority to the Grant.
Any other residuary beneficiary e.g. any person who is entitled to a share in the remainder of the Testator’s estate.
The personal representative of anyone in (2) above e.g. if the Testator left his estate to X who survived the Testator but died before taking out the Grant, then his personal representative could do this in his place.
A person who was left a gift in the Will e.g. a gift of money or a property.
The personal representative of anyone in (4) above.
Translation - French Lettre d’Homologation
Lorsqu’une personne fait un testament, elle désigne un Liquidateur qui sera chargé du règlement de la succession à son décès. Le Liquidateur a le pouvoir de vendre, d’encaisser les chèques ou de transférer les biens appartenant à la personne décédée (le Testateur) et de régler les frais funéraires, les dettes et toutes autres obligations du Testateur. De manière générale, lorsque les biens laissés par le Testateur dépassent la valeur de 5000 £, ils sont remis au Liquidateur sur présentation de la Lettre d’Homologation. Cette lettre, qui résulte d’une ordonnance rendue par La High Court of Justice («Haute Cour de Justice »), confirme les pouvoirs du Liquidateur à régler la succession du Testateur en Angleterre et au Pays de Galles.
Lettres d’Administration sous régime testamentaire
Le Testateur a probablement fait un testament valide, mais il n’a pas de Liquidateur. Le liquidateur est décédé avant le Testateur ou il ne peut agir en cette qualité en raison de problèmes de santé, de son grand âge ou d’une perte de fonctions intellectuelles. Le liquidateur peut décider qu’il ne souhaite pas régler la succession et il renonce donc à sa fonction. Sont listées ci-dessous, en ordre de priorité, les personnes qui sont autorisées à obtenir une lettre d’administration sous régime testamentaire :
Une personne qui détient en fiducie un legs résiduaire pour une autre personne, par exemple, lorsque le Testament prévoit un legs sur le reliquat de la succession du Testateur pour A et B en fiducie pour C et D, les personnes A et B recevront alors la lettre d’administration en priorité.
Tout autre bénéficiaire résiduaire, par exemple, une personne qui a droit à une part sur le reliquat de la succession du Testateur.
Le représentant successoral de toute personne visée au point 2 ci-dessus, par exemple, lorsque le Testateur a laissé son testament à X, lequel lui a survécu, mais est décédé avant d’obtenir la lettre d’administration. C’est alors son représentant successoral qui peut agir à sa place.
