Arrendatario / Arrendador (confirmation of an error)

I'm 98% certain this must be a mistake in the original but would appreciate confirmation (or explanation otherwise if the mistake is mine)

The context is a "Contrato de arrendamiento para uso distinto del de vivienda"

Clause Four refers to "La Entrega del Edificio"

"La Arrendataria entrega en este acto a la Arrendadora la posesión material del Edificio a que se refiere el presente Contrato
La Arrendataria ha examinado el Edificio, sus instalaciones y servicios y comprobado el estado de conservación y funcionamiento de todo ello, que encuentra conforme, por lo que declara recibir cuanto es objeto del Contrato a su entera satisfacción."

This is a new lease of a premises, the previous clauses define the building and stipulate the use thereof. It is not the "Vacating the Premises" clause (thats nº 23 - Entrega del Edificio a la finalización del Contrato)

Therefore surely the terms Lessee and Lessor are reversed in the first para above - logically the Arrendador - Lessor (owner) is handing over the premises to the Arrendatorio - Lessee (new tenant):

"The Lessor hereby hands over material possession of the Building referred to in this Lease Agreement to the Lessee."

Or am I missing something here?

Error in the lst SENTENCE, but not the 2nd Note that the 2nd SENTENCE says, "La arrendataria ha examinado ... por lo que declara recibir...", which is correct. I agree with Henry about the terms in the lst sentence: wrong - but don't change without notifying client.

But do not correct it Yes, the terms are reversed, but do not take it upon yourself to correct it in your translation. Leave it as is, insert [sic] and if you wish you can use a note to explain the error, among other things so no one thinks the error was yours!

Creo que tienes razón. Hay un error. El Arrendador entrega la posesión material al Arrendatario o, visto de otro modo, el Arrendatario dispone de la posesión material del inmueble mientras se encuentra vigente el arrendamiento. Es decir, el Arrendatario se encuentra materialmente en posesión del inmueble, sujeto a los términos del contrato de arrendamiento.
