I'd probably use submitted in this case for erhobene. In certain cases it can be translated as assert, as in "to assert a claim", but I don't think that would work in this case. I will leave the rest up to the legal beagles. Good luck!

I think you need not worry about the "erhoben" (which means "submitted" here), because the fact that there is a complaint means that it HAS in fact been made, and the "time-barred" means it is "out of time", or submitted too late.
