We have appeared at these hearings across Scotland and, to date, have been successful in persuading the courts to make no award on expenses against our lender clients. In response, solicitors for the borrowers have made a number of compelling submissions in an attempt to have the expenses of the disposal of actions awarded in their favour. Some borrowers have argued that expenses follow success and as the lenders are instigating disposal of their own actions, the lenders have been unsuccessful, therefore entitling the borrower to expenses.
