in a first default position, either as fabricated or the first set of MEMS actuators (2940) jointly pull, the second portion, suspended, such that it is positioned such that both the eighth waveguide of the third waveguide portion, suspended, and the ninth waveguide on the fourth waveguide portion, suspended, can be coupled to the seventh waveguide, of the second portion, suspended, at the same time, thus enabling continuity between the third, eighth, seventh (2920), ninth and fourth waveguides on their respective portions of the cell;

wherein in a first default position, as fabricated, the suspended eighth waveguide of the third waveguide portion, suspended and the ninth waveguide of the fourth waveguide portion, suspended, are sufficiently apart of the second suspended waveguide portion of the cell, allowing it to move from its first to its second position;

@ Asker I can't help thinking there's something wrong with that first instance? The second instance of "default, as fabricated" makes sense, but I can't for the life of me see where the alternative implied by 'or' comes into the first instance??
Do you have this patent in any other languages you might be able to check against?
