Deze procedure onderscheidt zich in niets van de normale, inhoudelijke ontbindingsprocedure. Het enige verschil is dat in een dergelijke zaak de Kantonrechter om ontbinding van de arbeidsovereenkomst wordt verzocht, voor zover (later) in rechte mochten komen vast te staan dat er nog een arbeidsovereenkomst bestaat.
