Danish term
afgiftspantebrev
Excerpt from text to be translated:
Såfremt sælger bliver pålagt yderligere omkostninger i forbindelse med omdannelse af (ejer)pantebreve til afgiftspantebreve, refunderer køber disse over refusionsopgørelsen.
Sælger forpligter sig til ikke at aflyse evt. afgiftspantebrev(e), idet disse overtages af køber.
Here is a great explanation but I'm not sure there's anything equivalent in English?

A stamp duty mortgage (afgiftspantebrev) may also be registered on the property. This is not an ordinary mortgage and is merely a way of saving a registration fee that has already been paid for later use in connection with
repayment of an existing mortgage, i.e. if no new mortgage is registered
in connection with a redemption or if the existing mortgage exceeds the
new mortgage amount.

(Can.) collateral charge (E&W informal) equitable charge
CIBC / Canadian Imperial Bank of Commerce (CIBC): 'With a collateral charge, you may be able to borrow more funds against your property in the future without registering a new charge. This helps you avoid legal and other fees, because the collateral charge may be registered for more than the amount of the original mortgage.'

You, Pernille, are welcome ! Having done a lot of conveyancing and UK stamp-duty payment myself, I still have misgivings over the apparent ambiguity of the official translation as a 'stamp-duty mortgage'.
The latter could mean a mortgage taken out to pay the stamp duty (land registration fees IMO are also covered by the Danish source term) or a 'dutiable' mortgage, so subject to stamp duty fees.
I'm not sure it means either - rather, as in the first weblinked answer, the opposite, namely a charge exempt from such a hit.
Selvom det virker misvisende, er et afgiftspantebrev ikke et pantebrev, men de ligner dog hinanden på mange måder.
If you sign up for a registered mortgage, you must pay 5% of your home value in stamp duties. In contrast, you have to pay between 0.1% and 02% of your real estate value for an equitable mortgage stamp duty.

This is excellent, thank you! The target audience is a non-English speaking buyer in an EU country. |
Hi there - thank you for your time and effort with my questions but I had to pick whatever the client preferred, which, in both cases was the other suggested term. Tak once gain, Perni |
