Source text - English En primer lugar, hago referencia a las unidades identificadas como XXX, XXX X y XXX X, sobre las cuales se inscribieron embargos desde hace años atrás a favor del XXX XXX XXX y que a la fecha ya fueron adjudicadas por orden judicial a favor de esta persona, situación que ya fue inscrita en el Registro Público de la Propiedad y del Comercio del Estado, razón por la cual dichos inmuebles ya no son propiedad de XXXXXXXXXX XXX, XX y se denegó la inscripción del embargo y del Contrato de Arrendamiento; en este caso, la acción a seguir es la interposición de un juicio de amparo en contra del acto de adjudicación, alegando la transgresión del derecho del tanto que le asiste a los condóminos para adquirir el inmueble adjudicado, el contrato de arrendamiento existente, el adeudo de cuotas de mantenimiento y la imposibilidad de dichos inmuebles de fungir como áreas privativas en función de su naturaleza de áreas comunes. Al respecto, es importante tener en cuenta que en caso de promover este juicio se generaran nuevos gastos para el Condominio, no solo los que se causen por nuestros honorarios, sino también, los que solicite el juez para garantizar la suspensión del acto reclamado.
Ahora bien, por lo que respecta a la unidad identificada como XXX, desde el año XXX la XXX XXXX XXX promovió un juicio en contra de XXXX XXXXXXX, XX. y trabó un embargo sobre dicha unidad, a la fecha esta unidad continúa siendo propiedad de la empresa, y sobre ella se inscribió el embargo logrado por XXXXXX; así mismo, pese a que nos fue denegada la inscripción del contrato de arrendamiento en dicho folio, el despacho está promoviendo recurso de inconformidad en contra de esta determinación, con la finalidad que se revoque y sea inscrito dicho contrato.
Translation - Spanish First, I refer to Units identified as XXX, XXX X and XXX X, on which seizures were registered since one year ago in favor of XXX XXX XXX and to this date these were awarded by judicial order in favor of this person, a situation that has already been filed with the Public Registry for Property and Commerce of this State, a reason for which said real estate properties are no longer owned by XXXX XXXXXXX, XX. and the registration was denied for seizure as well as the Leasing Agreement; in such case, the next procedure shall be filing an Amparo Trial against assignment, by claiming violation of preemptive rights of the condominium owners, in order to acquire the assigned real estate property, the existing leasing agreement, pending maintenance fees and not being possible for the said real estate properties to be considered as private areas, in regard to their nature as common areas. In such regard, it is important to keep in mind that in case this trial is filed, new expenditures shall be created for the Condominium, not only those caused by our professional fees, but those requested by the judge in order to guarantee, the suspension of the claimed matter.
Now, in regard to the unit identified as XXX, from XXX XXX filed a suit against XXXX XXXXXXX, XX. and she claimed a seizure against such unit to this date this unit is still being owned by the corporation, and a seizure was filed on it by XXXXXXXXXXX; and as well, despite it was denied the filing of the leasing agreement in said matter, our firm is filing a disagreement proceeding against such resolution, with the purpose it is revoked and the said agreement is filed.
