I. INTRODUCTION
The Bureau of Hearings and Appeals (Bureau) is an administrative office authorized to conduct fair hearings involving the Department of Public Welfare (Department). The hearings are presided over by an Administrative Law Judge (ALJ). This brochure will provide information regarding recipient related appeals. Recipient related appeals are conducted in accordance with the regulations found at 55 Pa. Code Chapter 275.
II. FOUR TYPES OF HEARINGS
A. Telephone Hearing - Telephone Number You Provide
The appeal is handled over the telephone, on the date and time that appears on your notice. The
ALJ will call all parties involved in your case. There will be a telephone connection between you,
all witnesses, and the ALJ. The call will be placed at the telephone number you provide to the
Bureau. On the date of your hearing, please ensure that your phone number is unblocked and try to keep your telephone line clear of other calls at least 10 minutes before and after the time shown on your “Notice of Hearing Date and Time” letter. If you get disconnected during the hearing, please hang up. The Judge will call you right back. DO NOT CALL THE ALJ.
B. Telephone Hearing From the Program Office/CAO (County Assistance Office)
If you have not given us a telephone number where you can be reached, you should go to your Program Office/CAO for the hearing. If you are going to be at a different telephone number, please call the Site Administrator at the telephone number listed on your “Notice of Hearing Date and Time” letter.
C. Face-to-Face Hearing - All parties are Present
At a face-to-face hearing, your case is heard in a courtroom. The face-to-face hearing will be in one of six areas in Pennsylvania (Erie, Pittsburgh, Harrisburg, Reading, Wilkes-Barre, or Philadelphia) depending on where you live. If you have chosen a face-to-face hearing, the “Notice of Hearing Date and Time” will tell you where your hearing will be held.
D. Face-to-Face Hearing - Program Office/CAO Present by Phone
You may choose to have a face-to-face hearing in the courtroom, and allow the representative for the Program Office/CAO to remain at their office location. This option will allow you to see the judge, while the representative for the program office testifies by speaker phone.
III. THE JUDGE'S ROLE
The responsibilities of the ALJ include conducting the hearing. This includes gathering the facts necessary to decide whether or not the Program Office’s/CAO’s actions were correct. The ALJ must base his/her decision on the evidence presented during the hearing. The ALJ's decision must comply with the law. You will receive a copy of the ALJ's decision in writing. Occasionally, the ALJ will announce his/her decision orally at the conclusion of the hearing but you will always receive a written decision either handed to you at that time or sent to you in the mail.
IV. THE HEARING
The ALJ will conduct the hearing in an orderly but informal manner. The hearing will be recorded. The ALJ will ask all witnesses at the hearing to swear or affirm to tell the truth. Then, the ALJ will ask you to clarify the issue. The ALJ will ask the person or people (for example, your caseworker) from the Program Office/CAO to explain why they made their decision or took their action. After the Program Office's/CAO’s witness testifies, you or your representative may ask him or her questions. (This is called "cross-examination.")
Then it will be your turn to present your case. You should explain why you appealed and why you disagree with the things said at the hearing by the Program Office/CAO. If you have any witnesses, you or your representative may ask them questions. The people from the Program Office/CAO may cross-examine you and your witnesses.
No one is allowed to interrupt anyone who is testifying. The ALJ may ask anyone questions at any time.
If you have any papers to help prove what you have said at the hearing, be sure to tell the ALJ what they are. Tell the ALJ that you want to "introduce these papers into evidence." You should do this even if you have already mailed the papers to the ALJ before the hearing. If you need more time to get papers to the ALJ, be sure to tell him or her before the hearing is over. It may be too late if you tell the ALJ after the hearing is over.
V. YOUR RIGHTS
You Have the Right:
• To Have Someone Represent You at Your Hearing: You may be represented at your hearing by a lawyer, paralegal, friend, relative, or anyone else you choose. The Bureau does not provide you with a representative. If you would like to have an attorney for your hearing, but you can't afford one, please contact your local legal aid office for assistance.
If you choose not to have a representative, you may represent yourself.
• To See Your Case File: You can see any part of your file that is not confidential. You can see any part of the file that the caseworker will talk about or read from at the hearing. Your caseworker can make copies of the file for you, free of charge, up to ten (10) pages.
• To Have Witnesses: You may have people talk on your behalf at both the telephone hearing and the face-to-face hearing. If you would like to subpoena a witness, contact the Site Administrator before the hearing so that the witness will be notified in enough time to prepare for the hearing. In addition, you have the right to know prior to the hearing the names of the witnesses who will testify for the Program Office/CAO. Contact your Program Office/CAO for their witness information.
• To Submit Documents: You are responsible for proving what you say at the hearing. If you have any letters, notices, documents, or other papers that help prove your case, mail them to the ALJ right away. Be sure to keep a copy of them for your own use at the hearing. Before the hearing, you must also mail a copy of the papers to the Program Office/CAO that made the decision you are appealing. Conversely, at least five days prior to your hearing, you should receive a copy of the documents the Program Office/CAO intends to submit at the hearing to prove their case. (If you choose a face-to-face hearing, you do not have to mail them to the ALJ; keep them until the hearing.). Do not fax exhibits to the Bureau.
• To a Hearing Decision: You have the right to get a written hearing decision within 90 days after you filed your appeal for Cash Assistance or Medical Assistance, and within 60 days for Supplemental Nutrition Assistance Program (formerly known as food stamps). If you do not get your hearing decision within these times, you may call the Program Office/CAO and ask for benefits until the decision is made. This is called Interim Relief/Interim Assistance. Not all cases qualify, so contact your caseworker with questions.
• To Appeal the Judge's Decision: If you lose your appeal or are dissatisfied with the ALJ's decision, you may appeal to the Secretary of Public Welfare and the Commonwealth Court of Pennsylvania. The procedure for doing this will be explained in the written notice of the decision.
• To Withdraw Your Appeal: You, your representative or your attorney may withdraw your appeal at any time. Your withdrawal must be in writing and must be signed. You may check the box next to "I wish to withdraw my appeal at this time" on the "Reply to the Bureau of Hearings and Appeals," sign it, and return it to the Bureau. If you have already sent in the "Reply to the Bureau of Hearings and Appeals" and later want to withdraw your appeal, contact the office shown on the "Notice of Hearing Date and Time." The Bureau will provide you with further instruction. If you want to withdraw at the time of the hearing, tell the ALJ. Note: The Bureau may accept a withdrawal via text messaging, email or verbally on a telephone hotline. Please contact your local Program Office/CAO for more information.
• To Interpreters, Translation and Accommodations for Disabilities: If you need an interpreter at the hearing because you do not speak or have limited understanding of English, or because you have a hearing impairment, please call the Site Administrator or mail back the "Reply to Bureau of Hearings and Appeals" from the bottom of the "Notice of Hearing Date and Time" after checking the appropriate box. The Site Administrator can be reached through the telephone number on the "Notice of Hearing Date and Time." Free interpreter and translation services will be provided at the hearing and for any notices, hearing decisions, or any other documents that are sent to you. You may bring a friend or relative to assist you at the hearing, but the Bureau's interpreter will be the official interpreter. Individuals needing special accommodation because of their disability should notify the Site Administrator immediately in order to obtain assistance with any hearing.
VI. PREPARING FOR THE HEARING

hearing?
• Decide who will represent you at your hearing?
• Unblock your phone?
VII. PRE-HEARING CONFERENCE OPTION
It is a requirement of the Department to offer you a pre-hearing conference with a supervisor or manager after you have filed your appeal. By participating in this pre-hearing conference you might be able to receive benefits sooner if you are eligible rather than wait for the fair hearing and subsequent decision. Therefore, you are encouraged to schedule a meeting with the Program Office/CAO to discuss the reasons why you disagree with their decision. If the issue is resolved, it may eliminate the need for a hearing altogether. In addition, if your circumstances have changed or you have information or documents that you feel may change the decision, you should inform the Program Office/CAO as soon as possible. If the new information or documents change the decision, the action may be cancelled and benefits may be authorized or returned to you.

Ontvangerverwante appèlle word behandel ingevolge die regulasies wat gevind word in 55 Pa. Kode Hoofstuk 275.
II. VIER SOORTE VERHORE
A. Telefoonverhoor – Telefoonnommer wat u verstrek
Die appèl word telefonies behandel, op die dag en tyd wat op u kennisgewingbrief verskyn. Die BR sal alle partye wat by u saak betrokke is, bel. Daar sal ’n telefoonverbinding tussen u, al die getuies en die BR wees. Die oproep sal geplaas word na die telefoonnommer wat u aan die Buro verstrek het. Op die dag van u verhoor moet u asseblief verseker dat u telefoonnomer nie geblokkeer is nie en dat u u telefoonlyn onbeset hou ten minste 10 minute voor en ná die tyd wat op u “Kennisgewing van verhoordag en -tyd”-brief aangegee word. As u verbinding tydens die verhoor verbreek word, moet u asseblief die oproep aflui. Die regter sal u terugbel. MOENIE DIE BR BEL NIE.
B. Telefoonverhoor vanaf die Programkantoor/GBK (Graafskap-bystandskantoor)
Indien u ons nie ’n telefoonnommer verstrek het waarby ons u kan skakel nie, moet u na u Programkantoor/GBK gaan vir die verhoor. As u by ’n ander telefoonnommer geskakel gaan word, moet u asseblief die perseelbeheerder skakel by die telefoonnommer wat op u “Kennisgewing van verhoordag en -tyd”-brief gelys word.
C. Verhoor van aangesig tot aangesig - Alle partye is teenwoordig
By ’n verhoor van aangesig tot aangesig, sal u saak in ’n hofsaal aangehoor word. Die verhoor van aangesig tot aangesig sal in een van die ses gebiede in Pennsilvanië plaasvind (Erie, Pittsburgh, Harrisburg, Reading, Wilkes-Barre of Philadelphia) afhangende van waar u woon. As u ’n verhoor van aangesig tot aangesig gekies het, sal die “Kennisgewing van verhoordag en -tyd” vir u sê waar u verhoor sal plaasvind.
D. Verhoor van aangesig van aangesig - Programkantoor/GBK Teenwoordig via telefoon
U kan kies om ’n verhoor van aangesig tot aangesig in die hofsaal te hê en toelaat dat die verteenwoordiger van die Programkantoor/GBK by hulle kantoorplek bly. Hierdie opsie sal u in staat stel om die regter te sien terwyl die verteenwoordiger van die programkantoor via luidsprekerfoon getuienis aflê.
III. DIE REGTER SE ROL
Die verantwoordelikhede van die BR sluit die leiding van die verhoor in. Dit behels die versameling van feite wat nodig is om te besluit of die Programkantoor/GBK se optrede korrek was. Die BR moet sy/haar beslissing grond op die bewyse wat tydens die verhoor gelewer is. Die BR se beslissing moet aan die wet voldoen. U sal ’n geskrewe eksemplaar van die BR se beslissing ontvang. Die BR sal by tye aan die einde van die verhoor sy/haar beslissing mondeling aankondig, maar u sal altyd ’n geskrewe beslissing ontvang wat óf direk aan u gegee sal word óf per pos aan u gestuur sal word.
IV. DIE VERHOOR
Die BR sal die verhoor op ’n ordelike maar informele manier lei. Die verhoor sal opgeneem word. Die BR sal alle getuies wat by die verhoor teenwoordig is, vra om te sweer of te verklaar om die waarheid te vertel. Daarna sal die BR u vra om te kwessie te verduidelik. Die BR sal die persoon of persone (byvoorbeeld u maatskaplike werker) van die Programkantoor/GBK vra om te verduidelik waarom hulle hul beslissing of aksie geneem het. Nadat die Programkantoor/GBK se getuie getuienis afgelê het, mag u of u verteenwoordiger hom of haar vrae vra. (Dit word “kruisondervraging” genoem.)
Dan sal dit u beurt wees om u saak te stel. U moet verduidelik waarom u geappelleer het en waarom nie saamstem met die dinge wat tydens die verhoor by die Programkantoor/GBK gesê is nie. As u enige getuies het, mag u of u verteenwoordiger vrae aan hulle stel. Die mense van die Programkantoor/GBK mag u of u getuies kruisondervra.
Niemand mag enigiemand wat getuig, in die rede val nie. Die BR mag enigiemand te eniger tyd vrae vra.
As u papiere het ter stawing van wat u tydens die verhoor gesê het, moet u toesien dat u die BR vertel wat dit is. Vertel die BR dat u “hierdie papiere as bewys wil voorlê”. U moet dit doen al het u reeds die papiere voor die verhoor aan die BR gestuur. As u meer tyd benodig om die BR van die papiere te voorsien, moet u seker maak om hom of haar voor afloop van die verhoor te vertel. Dit sal miskien te laat wees as u die BR na afloop van die verhoor daarvan vertel
V. U REGTE
U het die reg:
• Om iemand te hê wat u tydens u verhoor verteenwoordig: U mag verteenwoordig word by u verhoor deur ’n regsgeleerde, regsassistent, vriend, familielid of enigiemand anders wat u kies. Die Buro voorsien u nie van ’n verteenwoordiger nie. As u ’n advokaat vir u verhoor wil hê, maar u nie een kan bekostig nie, moet u asseblief u plaaslike regshulpburo om hulp vra. U kan kies om nie ’n verteenwoordiger te hê nie, u kan uself verteenwoordig.
• Om u dossier te sien: U kan enige deel van u dossier sien wat nie vertroulik is nie. U kan enige deel van die dossier sien wat die maatskaplike werker by die verhoor sal voorlees of bespreek. U maatskaplike werker kan gratis afskrifte van die lêer vir u maak, tot tien (10) bladsye.
• Om getuies te hê: U mag persone hê wat namens u praat by die telefoonverhoor sowel as by die verhoor van aangesig tot aangesig. As u ’n getuie wil dagvaar, moet u die perseelbeheerder voor die verhoor kontak sodat die getuie vroeg genoeg in kennis gestel sal word om vir die verhoor voor te berei. Daarby sal u die reg hê om voor die verhoor te weet wat die name van die getuies is wat vir die Programkantoor/GBK sal getuig. Kontak u Programkantoor/GBK vir hul getuie-inligting.
• Om dokumente voor te lê: U het die verantwoordelikheid om dit wat u by die verhoor sê, te bewys. As u enige briewe, kennisgewings, dokumente of ander papiere het wat u saak kan help bewys, moet u dit meteens aan die BR pos. Maak seker om afskrifte daarvan te hou vir persoonlike gebruik by die verhoor. Voor die verhoor moet u ook afskrifte van die papiere aan die Programkantoor/GBK pos wat die beslissing waarteen u appelleer, geneem het. Daarenteen moet u ten minste vyf dae voor u verhoor ’n afskrif van die dokumente ontvang wat die Programkantoor/GBK by die verhoor wil indien om hulle saak te bewys. (Indien u verkies om van aangesig tot aangesig verhoor te word, hoef u dit nie aan die BR te pos nie; hou dit totdat die verhoor afgehandel is.) Moenie die bewysstukke aan die Buro faks nie.
• Op ’n verhoorbeslissing: U het die reg om ’n geskrewe verhoorbeslissing binne 90 dae te kry nadat u beroep gedoen het vir u Kontantbystand of Mediese Hulp, en binne 60 dae vir die Program vir Supplementêre Voedingshulp (voorheen bekend as koskoepons). As u nie u verhoorbeslissing binne hierdie tydgrens ontvang nie, kan u die Programkantoor/GBK bel en om bystandstoelae vra totdat die beslissing geneem word. Dit word Tussentydse Verligting/Tussentydse Bystand genoem. Nie alle gevalle kom in aanmerking nie, dus moet u u maatskaplike werker raadpleeg.
• Om teen die regter se beslissing te appelleer: As u die appèl verloor of u ontevrede is met die BR se beslissing, mag u na die Sekretaris van Openbare Welsyn en die Gemenebeshof van Pennsilvanië. Die prosedure waarvolgens dit gedoen word, sal in die geskrewe beslissingskennisgewing verduidelik word.
• Om u appèl te laat vaar: U, u verteenwoordiger of u advokaat mag te eniger tyd u appèl laat vaar. U onttrekking moet skriftelik en onderteken wees. U mag ’n kruisie trek in die blokkie langs “Ek wil my appèl tans laat vaar” op die “Antwoord aan die Buro vir Verhore en Appèlle”, dit teken en dit aan die Buro teruggee. As u reeds die “Antwoord aan die Buro vir Verhore en Appèlle” ingedien het en later u appèl wil intrek, moet u die kantoor kontak wat op die “Kennisgewing van verhoordag en -tyd" verskyn. Die Buro sal u verdere aanwysings gee. As u tydens die verhoor die appèl wil intrek, moet u die BR in kennis stel. Let wel: Die Buro kan ’n intrekking aanvaar via SMS, e-pos of mondeling via ’n telefoonkitslyn. Kontak asseblief u plaaslike Programkantoor/GBK vir meer inligting.
• Op tolke, vertaling en geriewe vir gestremdhede: As u ’n tolk by die verhoor benodig omdat u nie Engels praat of ’n beperkte begrip van Engels het of omdat u gehoorgestremd is, moet u asseblief die perseelbeheerder skakel of die “Antwoord aan die Buro vir Verhore en Appèlle” van die onderkant van die “Kennisgewing van verhoordag en -tyd" terugpos nadat u in die gepaste blokkie gemerk het. Die perseelbeheerder kan by die telefoonnommer op die “Kennisgewing van Verhoordag en -tyd" bereik word. Gratis tolk- en vertaaldienste sal beskikbaar gestel word by die verhoor en vir kennisgewings, verhoorbeslissings of enige ander dokumente wat aan u gestuur word. U mag ’n vriend of familielid saambring om u by die verhoor by te staan, maar die Buro se tolk sal die amptelike tolk wees. Persone wat spesiale voorsieninge nodig het weens hul gestremdheid moet die Perseelbeheerder onmiddellik in kennis stel om hulp by enige verhoor te verkry.
VI. VOORBEREIDING VIR DIE VERHOOR
Het u onthou om:
• Alle dokumente vir u saak bymekaar te maak en dit aan die BR en die GBK/Program/Kantoor te pos?
• Getuies vir u saak te identifiseer?
• Seker te maak dat u en u getuies kennis dra van die dag, tyd en plek van u verhoor?
• Te besluit wie u by u verhoor sal verteenwoordig?
• U telefoon te deblokkeer?
VII. OPSIE OP ’N VOORVERHOORKONFERENSIE
Die Departement vereis dat u ’n voorverhoorkonferensie met ’n toesighouer of bestuurder gebied word nadat u appèl aangeteken het. Deur deel te neem aan hierdie voorverhoorkonferensie sal u moontlik u toelae vroeër ontvang eerder as om vir die billike verhoor en die latere beslissing te wag. U word dus aangespoor om ’n vergadering met die Programkantoor/GBK te reël om die redes waarom u nie met hulle beslissing saamstem nie, te bespreek. As die kwessie geskik word, kan dit die behoefte aan ’n verhoor heeltemal uitskakel. Ook moet u die Programkantoor/GBK so gou moontlik in kennis stel as u omstandighede verander het of as u inligting of dokumente het wat u meen die beslissing moontlik sal verander. As die nuwe inligting of dokumente die beslissing verander, sal die aksie afgewys kan word en toelae aan u toegeken of terugbesorg kan word.
