I dette kursus har jeg til hensigt at gennemgå retsplejelovens første bog "Domsmagten m.m." samt anden bog om "Fælles bestemmelser for borgerlige sager og straffesager", dvs. kapitlerne 1 til 20 (§§ 1 til 223a). Naturligvis med særlig vægt på de områder, der erfaringsmæssigt forekommer ofte/volder problemer i oversættelser. Description
I juridisk lingvistik er det vigtige første spørgsmål aldrig "Hvad hedder ....", men derimod "Hvad er ...." Juridisk oversættelse er som kun få andre discipliner karakteriseret ved, at der ikke er nogen konkret reference i den ydre verden, hvortil ord og begreber knytter sig (som i f.eks. teknisk oversættelse). Derfor er det for at opnå et vellykket resultat af oversættelsesprocessen helt afgørende, at man konkret ved, hvad man har med at gøre.
Ud over, at man selvsagt skal undersøge, hvad ordet, vendingen, begrebet i udgangsteksten dækker over, er det væsentligt at vide, hvilke "kasser" man har at operere med i måltekstens retssystem. Selvom man, som det ikke sjældent er tilfældet, må "hugge en hæl...", når en juridisk oversættelse skal skrues sammen, skal man gøre sig klart, om man skal kigge i kasse A eller kasse B eller evt. skal lave sin egen kasse, hvis man har konstateret, at ingen kasser passer overhovedet.
Det betyder, at en gennemgang af de gældende regler med særlig henblik på terminologien og oversættelsesrelevante forhold omring reglerne er særdeles praktisk relevant for oversættere.
Hvis der er interesse for det, vil kursusrækken blive fortsat med "Dansk retsplejeterminologi - Borgerlige sager", "Dansk retsplejeterminologi -straffesager" ....foreløbige retsmidler, fogedsager, konkurssager, skiftesager osv. samt særlige procesformer, f.eks. familiesager.
Jeg er i den forbindelse meget interesseret i at høre fra alle jer "derude", hvad der er interesse for (og hvis der er interesse for helt andre retsområder, er jeg også meget interesseret i at høre om det).
