Spanish term

condiciones suspensivas copulativas

Spanish to English Law/Patents Law (general) de Chile
Según el diccionario jurídico por Tom West, "condición suspensiva" es "condition precedent" y según Alcaraz Varó y Hughes, es "suspensive condition".

Aquí está el contexto:

TERCERO: Declaraciones y Condiciones Precedentes. Se deja constancia que el Estudiante ha sido calificado como sujeto de garantía por la Comisión para los efectos del primer desembolso y siguientes del Financiamiento. No obstante, los desembolsos de los Créditos de los años posteriores de la Carrera quedan sujetos a la verificación de las siguientes condiciones suspensivas copulativas, según el caso: (a) Que la Comisión evalúe anualmente las siguientes circunstancias: (i) que las condiciones socio económicas del grupo familiar del Estudiante justifican el otorgamiento de cada uno de los Préstamos para el Financiamiento de sus estudios de educación superior, de acuerdo a los indicadores objetivos establecidos en el Reglamento; (ii) La determinación del Arancel que debe ser objeto del financiamiento del año a que se refiera la evaluación de la Comisión;

Discussion

AlexMiranda May 26, 2009:
I would not want to wager anything on it, but I would want to say that even though a suspensive condition and a condition precedent are the same, but that SC is probably how one calls it in Civil Law states (and possibly only in contracts of sale, I don't know), of which Luisiana an example. Here is a Delaware court giving the definition of SC, which swims, walks and talks like a CP duck:

"The Civil Code defines a “suspensive condition” as a conditional obligation
that “may not be enforced until the uncertain event occurs.” La.
Civ. Code art. 1767"

I like Eski's answer because it actually digs out that specific usage.

copulative conditions precedent

The "conditions precedent" (suspensivas) means that these conditions must be met before a duty to perfom arises. In this case, the student must meet the requirements in (a) (and there's probably a (b) as well). The "copulative" part means that they all have to be met. If one is met but the others aren't, your conditions precedent have not been met and the disbursement is not required.

suspensive conditions / conditions precedent

No soy de gran ayuda, lo siento.
Definiciones en diccionarios jurídicos monolingües:

"suspensive condition": "A suspensive condition is one which susends the fulfilment of the obligation until it has been performed. E.g., if a man bind himself to pay one hundred dollars upon condition that the ship Thomas Jefferson shall arrive from Europe. The obligation in this case, is suspended until the arrival of the ship, when the condition having been performed, the obligation becomes absolute and is no longer conditional. A suspensive condition is in fact a condition precedent." (http://www.lectlaw.com/def/c270.htm)

Condition precedent: "condition precedent n. 1) in a contract, an event which must take place before a party to a contract must perform or do their part." (http://legal-dictionary.thefreedictionary.com/condition prec...

As you can see, the definition is basically the same.
