Portuguese term

É a teoria da relação da ocupação fática. teoria da ocupação/ ocupação fática

Portuguese to English Law/Patents Law: Contract(s) teoria da relação de trabalho
Hi Can anybody help me with this translation? It is formal writing.

I translated as "the theory of the relationship of the factual occupation" but not satisfied the paragraphs are:

"Os autores alemães defendem a teoria da incorporação, em que o contrato nada mais cria do que uma relação obrigacional, sujeita aos princípios gerais do direito das obrigações. É a teoria da relação da ocupação fática."

"Verifica-se, diante deste posicionamento doutrinário, que a teoria da relação de trabalho se subdivide em teoria da ocupação, ocupação fática ou incorporação."

Thank you

de facto employment relationship

Apparently this is originally a German concept which was translated to Portuguese.

It's the theory of the relationship of factual occupation. theory of occupation / factual occupation

I found no reference to such theories. However, I did find the following context, which mentions "factual occupation":

"Lack of international legal personality as peoples, tribes, or nations meant that Indigenous peoples occupation of territory was acknowledged as factual occupation, not recognizable by law, ..."

PS: For future reference, I suggest breaking down the terms rather than lumping them all together.

Note: It seems to me the sentence with the word "relationship" is poorly worded. Normally, when we talk about a relationship, there is always a correlation, for example, the relationship between A and B. The sentence sounds incomplete and nonsensical.

PS: I meant the last sentence of the paragraph starting with "Os autores alemães" and ending with "É a teoria da relação da ocupação fática."
Note from asker:
"de facto employment relationship" was better but I just wanted to thank you for your effort.
