The distinction between dolus eventualis and conscious negligence (luxuria) is a very fine one. In the first instance, the person knows about his or her infection and that his or her action may infect the other person, but does not care or quite happily accepts that this may be the result of his or her behaviour. In the case of conscious negligence, the person knows about the possibility of infection but hopes or believes that nothing will happen.

Ο ενδεχόμενος δόλος αναφέρεται στο άρθρο 25 παρ. 2 του Ποινικού Κώδικα: επίσης όποιος γνωρίζει ότι από την πράξη του ενδέχεται να παραχθούν αυτά τα περιστατικά και το αποδέχεται.
Ο Κεραμέας - Κοζύρης στο Introduction to Greek Law το αναλύουν ως εξής: "acceptance of consequence as possible by-product of his intended act (art. 27 II: eg. A burns his own building with intent to defraud an insurance company; he accepts the possibility that an invalid living there may perish).
