Thank you for taking the time to comment. Obviously, we have a dilemma here, bearing in mindwe are dealing with a 'Swiss German text'. As you know, Switzerland is a (German) Civil Law country while asker resides ina Common Law country.

Not possible in the UK to take a lien over a business or land, though it might be in the US.
Either a floating charge is taken over the undertaking of a company or a farmer's business personally (UK Agricultural Credits Act 1928) - or else a fixed charge is taken over land. In this Swiss case, it looks like a fixed charge is taken over both the trade and land.

In E&W, this inheritance scenario might raise the spectre of a a 'floating constructive trust' crystallising on the death of one maker of a joint or mutula Will: Birmingham vs. Renfrew (1937).
