In legal lingo, these phrases always sound pretty aggressive. Aufforderung is always a 'demand' and Äußerung 'a response' (to a demand as is the case here).

The declaration of termination may already be filed upon a failure to respond to a 'notice of demand for a response'

would be the Canadian equivalent to the Austrian concept:
