par le seul défaut = by simply neglecting/failing to...

Why translate "seul"? It is clearly implied. Also, it sounds a little awkward in English legalese.

You could reorganize the sentence to better understand it:

par le seul défaut de d'effectuer le dit dépôt, la réservation sera nulle si bon semble...sans qu'il y ait...

You could say something on the lines of "neglecting to...will nullify the réservation (contract)..."

I'd advise about following the French syntax here. Sentence reorganization into English without changing meaning is key.

Reorganizing the French> English translation is key to making the sentence read like natural English (I'm writing English like a French native these days).

or: simply by having failed/failing to...

This slightly odd word order with "le seul..." has come up before, but AFAIK there isn't really a much less clumsy way of rendering it in legalese language.
