In the applicant's view, a locking device such as used for a bag or a suitcase must necessarily consist of two different parts which serve to interlock the upper and lower parts of that bag or suitcase. In the contested CTM this function is performed by the **upper elliptical plate** with the triangular tongue and the **lower rectangular plate**. The rectangular and the elliptical forms permit a simple and efficient fixation of the **plates** by applying blind rivets in each comer of the **plates**. The **upper and lower plates** are attached to the bag by two blind rivets in each corner of the plates. Therefore, these blind rivets clearly perform a technical function. It is irrelevant that the same technical result could have been achieved by, for instance, a greater number of blind rivets or blind rivets with a rectangular head. Regardless of that, the circular form is the shape in which such rivets typically appear. Further, putting a blind rivet in each corner of the plates is technically the most obvious solution for attaching the plates to the bag.
