Key Principle – In accordance with Program financing Agreement, the Program Managing Contractor (PMC) will be responsible for recruiting the consulting firms and signing a contract with the successful consultants. As a key principle the consultant recruitment from the preparation of the Terms of Reference (TOR) up to contract signing will be processed jointly with PMU and in consultation with MOT’s departments in charge at key milestones to ensure quality and efficiency of the consultant services. PMU and MOT concerned departments will be responsible for meeting the requirements of the Program as well as those of the Government’s procedures.
Terms of Reference – Cost Estimate – The draft TOR prepared by PMU will be reviewed by the PMC Team and amended as required to refine and/or incorporate non-engineering components dealing in particular with gender and social inclusion related issues. The draft TOR will be prepared in consultation with the ADB to ensure that the TOR adequately addressed the Project requirements. The amended draft TOR will be further reviewed by and discussed with PMU and other concerned MOT departments. The final TOR will be appraised by MOT through its concerned departments. Upon completion of the TOR the staffing requirements and the estimated DDD cost will be prepared by the PMCTeam in consultation with PMU.

Nguyên tắc chính –Theo Thỏa thuận Tài trợ Chương trình, Tư vấn Quản lý Chương trình (PMC) chịu trách nhiệm lựa chọn và ký hợp đồng với tư vấn trúng thầu. Từ bước lập Điều khoản tham chiếu (TOR) đến khi ký hợp đồng, Tư vấn PMC sẽ phối hợp với Ban QLDA và tham vấn với Bộ GTVT ở các mốc quan trọng để đảm bảo chất lượng và hiệu quả của dịch vụ tư vấn. Ban QLDA, các Cục, Vụ liên quan thuộc Bộ GTVT có trách nhiệm tuân thủ quy trình phê duyệt theo quy định của Chương trình cũng như của Chính phủ Việt Nam.
TOR và Dự toán: Dự thảo TOR do Ban QLDA lập sẽ được Tư vấn PMC rà soát và chỉnh sửa và/hoặc bổ sung các hợp phần phi kỹ thuật, đặc biệt là giải quyết các vấn đề liên quan đến lống ghép giới và xã hội. Dự thảo TOR sẽ được tham vấn ADB để đảm bảo TOR đáp ứng đầy đủ các yêu cầu của dự án. Sau khi điều chỉnh TOR sẽ tiếp tục lấy ý kiến Ban QLDA và các Cục, Vụ thuộc Bộ GTVT. Dự thảo cuối cùng TOR sẽ được Bộ GTVT - thông qua các Cục, Vụ liên quan - thẩm định. Sau khi hoàn thành TOR, Tư vấn sẽ tham vấn với Ban QLDA để lập yêu cầu nhân sự, dự toán chi phí DDD.
