Art. 36. El Libro de Familia se abre con la certificación del matrimonio no secreto y contiene sucesivas hojas destinadas a certificar las indicaciones registrales sobre el régimen económico de la sociedad conyugal, el nacimiento de los hijos comunes y de los adoptados conjuntamente por ambos contrayentes, el fallecimiento de los cónyuges y la nulidad, divorcio o separación del matrimonio.
También se entregará Libro de Familia al progenitor o progenitores de un hijo no matrimonial y a la persona o personas que adopten a un menor. Se hará constar, en su caso, el matrimonio que posteriormente contraigan entre sí los titulares del Libro.
En el Libro se asentará con valor de certificaciones cualquier hecho que afecte a la patria potestad y la defunción de los hijos, si ocurre antes de la emancipación.
Los asientos-certificaciones son en extracto, sin transcripción de notas y en los de nacimientos no se expresará la clase de filiación. Pueden rectificarse en virtud de ulterior asiento-certificación.
Translation - English Regulations of the Civil Register Law
Art. 36. The Family Book is opened with the certification of a public marriage and contains subsequent pages for certifying the registered particulars of the matrimonial property status, the birth of children during the marriage and those adopted jointly by the marital partners, the death of the marital partners and the nullity, divorce or separation of the marital partners.
The Family Book is also given to the parent or parents of a child born out of wedlock and to the person or persons who adopt a child. In such case, should a marriage subsequently take place between the interested parties of the said Family Book, it will be recorded therein.
Any event that affects the parental authority and death of the children, if it occurs before emancipation, will be entered as a certified event.
The entries-certifications are extracts with transcription of notes, and no blood relationship is stated in the birth extracts. They may be rectified by virtue of a subsequent entry-certification.
