Translation - English LEGAL GROUNDS
FIRST. The Petitioner seeks dissolution of the marriage by divorce in accordance with the provisions of Article 86 of the Spanish Civil Code. According to this provision established by Spanish Law 15/2005, the dissolution of marriage by divorce only stipulates that one of the spouses requests it and providing that the requirements of Article 81 of the Spanish Civil Code are met, i.e. that three months have passed since the marriage was celebrated, in accordance with Article 86 following the reform made by this law, the petition may therefore be granted.
SECOND. In addition to the divorce, the Petitioner also seeks the implementation of personal and financial measures, which are contained in the petition. The Respondent consented to these measures, with the details specified forthwith, and this agreement was duly ratified at the hearing and consequently approved by the Public Prosecutor. With there being no risk of harm to the spouses or to the interests of the underage daughter, in conformance with Article 90 of the Spanish Civil Code and 774.1 of the Spanish Civil Procedure Act, the agreement may be approved.
THIRD. With regards to legal fees, given the special nature of this type of proceedings and in order for the divorce petition requested by both parties to be granted, no costs will be levied on either of the parties.
In view of the aforementioned legal provisions and any others which may be applied in general or specific terms,
