وهو عبارة عن جزء من المال يتم النص عليه مثلا في عقود الزواج يتم بمقتضاه منح من بقي من الأزواج علي قيد الحياة جزء معين من الميراث قبل أن يتم تقسيمه

La clause de préciput (mot qui vient du latin: pre-capere, c'est-à-dire prendre avant) permet au survivant des époux, de reprendre en nature, avant le partage, certains biens dépendant du patrimoine commun, sans devoir les imputer sur sa part. L'avantage revient à l'époux survivant, et il est réciproque, parce qu'en théorie, il n'est pas possible de déterminer avec précision qui sera le survivant.
